DEED Hutson to Shumate 27 September 1842 THIS INDENTURE made this 27th day of September 1842 between James H. Hutson and and Susan A. Hutson his wife of the one part and John B. Shumate of the other part all of the County of Pittsylvania and State of Virginia. WITNESSETH that the said James H. Hutson and Susan his wife for and in consideration of the sum of one hundred and forty four dollars lawful money of Virginia to them in hand paid the receipt whereof they do hereby acknowledge have granted bargained and sold and do by these presents grant bargain sell alien ensseoss and confirm unto the said John B. Shumate his heirs and assigns forever one certain tract or parcel of land lying in the County aforesaid on both sides of the Turnpike containing forty eight acres and bounded as follows: To wit: Beginning at Eanes corner red oak near the road thence with Eanes line North 8 and 1/2 West 68 poles to a new corner chestnut in Eanes line, thence a new line South 70 degrees East 152 poles crossing the road and a branch to Divins corner red oak thence with his line South 36 degrees West 58 poles crossing two branches to Swansons corner white oak thence North 70 degrees West 101 poles to the beginning. To have and to hold with all the privileges thereunto belonging or in anywise pertaining unto him the said John B. Shumate his heirs and assigns forever, and they the said James H. Hutson and Susan his wife for themselves their heirs and assigns forever will warrant and defend the right and title of the aforesaid land against the lawful claim or claims of any other person or persons whatever. In witness whereof the said James H. Hutson and Susan A. Hutson have hereunto set their hands and affixed their seals the day and year above first written. James H. Hutson Susan A. Hutson Signed sealed and delivered in the presence of Pittsylvania County to wit: We, Vincent Witcher and Nathaniel N. Witcher, Justices of the Peace in the County aforesaid in the State of Virginia do hereby certify that James H. Hutson a party to a certain deed bearing date on the 27th day of September 1842 and hereunto annexed personally appeared before us in our County aforesaid and acknowledged the same to be his act and deed and desired us to certify the said acknowledgement to the Clerk of the Court of the County aforesaid in order that the said deed may be recorded. And at the same time and place, Susan A. Hutson the wife of James H. Hutson parties to the deed aforesaid personally appeared before us and being examined by us privily and apart from her husband and having the deed aforesaid fully explained to her she the aforesaid Susan A. Hutson acknowledged the same to be her act and deed and declared that she had willingly signed sealed and delivered the same and that she wished not to retract it. Given under our hands and seals this 27th day of September 1842. V. Witcher Nathaniel N. Witcher At a Court held for the County of Pittsylvania the 21st day of Nov. 1842.
