    The records show that one George Smith, born in Pittsylvania County, Virginia, age 17 years, private (2nd) Company C, 46th Regiment Virginia Infantry, (also known as 1st Regiment of Infantry, Wise Legion and as 2nd Regiment Wise Brigade), Confederate States Army, enlisted 15 Dec 1863 at Camp Dismal, South Carolina, (also shown as 16 Dec 1863 at Adams Run, South Carolina). The company muster roll for January and February 1865, dated 28 February 1865, last on file, shows him present and no later record has been found.

    According to a manuscript genealogy written in 1902 by Abner Dennis Stultz, Nancy was a sister of Thomas Eggleton of Henry County. While there is no recorded proof, this tradition seems reliable. That would make her a daughter of Thomas (died 1775) and Nancy (Watson) Egleton of Petersburg, whose son Thomas (1764-1845) moved to Henry County.

    157 I have another story for you. The day John Henry Reynolds, his wife Sally Frances Wells Reynolds and children, Charlie Wade, Mary Ann, Tabitha, Bogie, Silas and Callie were moving from the cabin on John Henry's dads place(Allen Gilmer Reynolds) there wasn't a bridge across Turkeycock creek so they had to lead the horse and wagon across. Mary Ann, the oldest girl was carrying the baby, Callie. She dropped her in the creek. Of course they grabbed her up and got her across. But I heard Aunt Mary Ann and Aunt Callie laughing and talking about it when they were old. Their Dad had bought a farm on Rd. 57 on the left just across the road from the CLCC parsonage (County Line Christian Church). When John Henry died the place had to be sold to pay off debts. Charlie moved the whole family across the road to Swanson place where they share cropped for about 18 years, I think. Then they moved to his Uncle Charlie Well's place in about 1936 and share cropped there until 1946 when he bought Grady store.

    Their brother, Joseph Smith also served in the Civil War.

    171 I thought of the story I told you about Allen Wilbur Reynolds, my uncle the painter. You took a picture of the painting in Bassett. It's the one that has a boy sitting on a horse. This was at Dr. Richardson's office in Mt. Valley, VA. The boy was Wilbur. He was running in the hall at school (Callands school) bare-foot and got a huge splinter in his foot. When he got home his brother, Basil I. Reynolds (was killed in WWII) took him to the Dr. leading him on horseback. The heavy man was the Dr. I meant to take you up to see the Dr's place. It was restored by Max Kendall and sold to the present owner who lives there. It's only a mile above CLCC. Wilbur was an interesting fellow, very handsome and very talented. He taught himself to paint and also to play the mandolin. He was very good at both. He had a crazy since of humor and his best friend from childhood, Clifton Aaron was just as crazy. Clift lived in Roanoke and only visited Callands in the summer as a child. He came to stay with his Aunt Tabbie Aaron Coward but usually stayed with our family. The two of them learned to play musical instruments from mail order instructions. They build a small cabin with a fireplace and slept there and cooked over the fireplace when they were kids. They visited each other a couple of times a year after they married and always sat around playing the guitar and mandolin. They mailed an old dirty sock back and forth to each other for years on Christmas and birthdays. They were like two crazy kids all their lives. They both died young. Wilbur was only 62 and Clift was younger that that. Wilbur also build an airplane. Of course it wouldn't fly but it was quite the conversation piece, since it was covered in canvas and he had it hanging in a tree. One person could sit in it. He loved to tease children by pretending he had a baby chick in his hands and a lot of other crazy things. A very good friend of his, George Wells, who played the guitar with him had a recording made into an album in memory of Wilbur. They had taped themselves often and the tape has children talking in the background but it is a great keepsake in memory of Wilbur.

    His leaving has left an empty spot within my heart
    where no one can ever take his place
    but thank God for the precious memories
    and a mind that can conjure up his face.

    He filled many shoes for me as I was growing up.
    That of an uncle, a close friend,
    a dear brother, and so many times a loving father.
    To friends his ear, he was always willing to lend.

    He saw beauty where others saw none,
    His talent as an artist was well known,
    He heard music when some heard nothing,
    He was misunderstood and sometimes walked alone.

    He would listen to every ones problems
    and not a criticism would he offer
    but let you talk your way through them
    until the problems seemed softer.

    The children remember him for all the silly times
    he made them laugh, these memories we can never rob
    for he loved to tease dogs and children and ask,
    "Do you think the rain will hurt the rhubarb?"

    He loved and cared for so many of us
    with his gentleness of a butterfly.
    As long as we have these precious memories,
    the Wilbur we knew will never die.

    178 Allen Gilmer Reynolds married Martha Ann Jackson 24 May 1843. Their oldest son, Levi was born 5 years before their marriage. Levi C. Reynolds is shown on the 1850 Va Census with Allen & Martha. He is 12 years old and his brother, James Samuel is 6 years old. On the 1860 VA census, he appears as Chesley (the writing is ?, still with Allen and Martha; it could be Chester, he names a son Levi Chester). He is also shown on the 1860 Pennsylvania Census as Levi alongside his future wife Margaret Jane Reynolds. They are listed as farm helper and domestic helper in the household of Margaret's Uncle. We find no evidence that Levi served in either the Confederacy or with the Union Army. By 1870 they have their own family in Lancaster Co., Pennsylvania. Levi is found on a family history compiled by Sandra Bently Reynolds, wife of Harry Lovell Reynolds, Jr., which reports Levi as the son of Allen Gilmer and Martha Ann Jackson. Further investigation of the descendants of Levi and Margaret purports that Margaret Jane and Levi were cousins, although none of their descendants have discovered how they may have been related. I believe Levi is Martha's son that she named for her uncle Levi, in whose household she lived after the death of her mother, Judith Emmerson. Two of Martha's younger siblings are mentioned in the Will of Levi; who left them property provided they remained with his wife Ann (Judith's sister) until her death.

    I have to withdraw my suggested identification of Susannah Hudlesey as a candidate for Susannah Carter, last wife of Thomas of Goochland Carter. I recently found that she instead married a man named William Arrington after the death of Charles Hudlesey. Susannah and her husband William Arrington in a deed [DB 3/218] dated 20 Mar 1738 sold the 100 acres on the river that was the plantation of Charles Hudlesey which was sold to Susannah by Robert Carter in 1729. This land was not part of the property on Beaverdam Creek owned by Charles Hudlesey but was in fact a dividend of the land on the James River purchased jointly by Robert Carter, Charles Huddlesey and John Webb from Tarlton Woodson and was part of the Lickinghole Survey. Two years earlier in a deed dated 19 Apr 1736 [DB 2/209] Arrington deeded 400 acres on Deep Creek to John Bibey(Bibee or Bybe) with wife Susannah relinquishing dower rights.

    I continue to believe that the motivation that led Susannah Hulsey to execute the deed of gift to son Charles Hulsey when he was so young was to prevent the land from becoming the property of her new husband to be.

    Holly Carter Dunlap reports / sorts the Carter Cousins with just the three identifiable tests to Haplogroup Q. (Most Kits have no ancestry). She contends this sets the Thomas of Goochland Carters apart from the Theodricks in Halifax County VA, where they have just one tenuous link to Haplogroup J from Kit No. 23874. Too early to say.

    Nothing wrong with markers No. 6 or No. 12 being off by just one count. *

    There is some ligitimate confusion - and some minor discrepencies in the collective data -
    BUT we can not overlook a daughter Susannah and a son Baynes for Thomas JUNIOR.

    No one, repeat no one, has yet noted and separated the THREE Thomas Carters of Goochland. Because of the lack of dates of birth, there was - and remains - much legitimate confusion over the Thomas Carters of Goochland. First of all, the Gen. Carter book on Josiah set all of us off on the wrong track when it came to the Thomas Carters; and then, the books on the Presidents added to the confusion with the several lines of Thomas Carters from Virginia down in the Carolinas and Georgia. Don't forget that Thomas of Mecklenburg is proven in Georgia and is the proven first cousin of Thomas Jr. of Goochland! We just don't know.

    To wit: "About the time Josiah Carter transferred the Reedy Creek property to his brother Baynes, Josiah, along with a contingent of other Henry County, Virginia, families, migrated farther south to the state of Georgia".

    To wit: ""Thomas Carter in Goochland married Mary Kilpatrick dau of Alexander Kilpatrick & Easley woman(you can find two sons birth date in Douglas Reg in Goochland. Mary's bro died in (I can remember right now) S.C. I think and in his WILL he Names Thomas Carter in Goochland & son Alexander Carter (Mary's Husband & son.)"

    No, these are not Thomas Carters of Goochland - but don't cousins and inlaws count?
    Dan Wallace is beginning to sort this out and from his material below, he appears to conclude:

    Was it then Thomas III who married Mary Kilpatrick in 1751 - OR - a Thomas Carter of Barford, Lancaster County, Virginia? It would certainly NOT make sense for Thomas III to marry in Goochland (on the James River), and then have a son marry back up in Lancaster (on the Rappahannock).(The listings for a Thomas Carter III of Oglethorpe, Georgia are erroneous confusion for the son of Thomas of Mecklenburg).

    On the other hand, wouldn't it make Common Sense (but by no means proof) for a proven marriage in 1751 with the birth of your first-born Thomas III in 1753? To date, we have no Thomas Carter of Lancaster County born circa 1753 unaccounted for. (Thomas Preston Carter of the Barford is well proven with a marriage to Susannah Gaines). Once again, we just don't know. Has Linda next, confused another pair of Thomas Carters?

    Have discovered Thomas in the DAR Patriot Index, b. 19 June 1753, d. 9 Feb 1825. Marriage Record in Early Virginia Marriages by Southern Book Co., 1953, lists marriage as 21 Nov 1771. A Family Bible of Thomas' son, John W. Carter, gives Thomas' parents as Thomas Carter and Mary Kilpatrick. Their marriage is in the Douglas Register, page 14, indicating that the marriage was recorded on pages 21-26 of the Parish Register of Goochland begun ANNO 1756 by William Douglas, Minister. (Fay Parrish Wade of the Carter Society of Virginia has a transcription of this bible).

    Thomas Carter was born 19 June 1753 VA and he died 9 Feb 1825 VA. He married Elizabeth Doggett 21 Nov 1771. Looking for ancestors of both Thomas & Elizabeth. Thomas served in the Revolutionary War.

    Yes, until Thomas IV, we have had exquisite details on the wills and deaths, but not a word on the births. Therefore, we MUST use Senior, Junior and Thomas III in all future discussions. Separately, Holly Carter has posted contra info that Thomas of Mecklenburg (of Robert) is her ancestor, and he is NOT Thomas instant who is proven in Georgia; and then, she is the only person to date to openly question which Thomas married Kilpatrick:

    I expect they are two different couples as the Kilpatrick-Carter
    couple seem to have lived earlier than the Killypatrick-Carter couple.

    Finally, with the date of marriage of Thomas III to Mary Kilpatrick in 1751, we again need to move the dates of birth back for the children of Thomas II from the thirties to the late twenties (yet allow for the birth of Baynes in 1745)! These are still Best Guesses. The entry in the Douglas Register by itself does not prove which Thomas married Mary Kilpatrick; however, if we ADD Dan's work on the Mary Carroll marriage below, then we have a solid "body of circumstantial evidence".

    The point taken from Holly Carter Dunlop above is that none of us has a firm handle on the dating of these Carters of Goochland.

    For example, in a prior message from Dan Wallace: "Thomas Carter Jr.'s [that's Junior] Last Will and Testament was written 14 February 1760 and was recorded in Goochland County on 19 April 1763. If his sons were named in chronological order, his oldest would have been Thomas [III], then John, then Josiah, then Baynes. In his Will, Thomas Carter refers to his ?Youngest sons, that is to say John Carter, Josiar [sic] Carter, and Baynes Carter.? He also refers to his wife Mary Carter. Mary may have been Mary Kilpatrick based on the 1751 marriage recorded in the Douglas Register for Thomas Carter to Mary Kilpatrick".

    Even Dan Wallace originally skipped a generation! A marriage in 1751 HAS to be Thomas III.
    Once again with emphasis, it's Senior, Junior and Thomas the Third.

    There are a few more fact relating to Thomas of Goochland Carter that seem important. They should be posted to the forum at some point. Some of the following repeats what I may have already sent but it allows for the references I make to other paragraphs.

    1. In 1720 Thomas Carter purchased [Henrico COB 719-1724/242] 100a in Henrico County, Virginia on the north side of the James River at the east end of the Licking hole survey of John Woodson. Another 200a was deeded at the same time to Robert Carter , Charles Huddlesey and John Webb. These transactions are recorded in Henrico County COB 1719-1724 by the Feb Court of 1722. All of the participants in these transactions must have been born prior to 1700.

    2. On 17 Aug 1725 at the cost of 35 shillings, a patent [VPB 12/301] was issued for 327a to Robert Carter in Henrico County on the south side of the James River adjacent to Robert Hughes including 1 mile of river front that encompasses the present day town of Cartersville. The Carter tract joined the Hughes track at a corner ash on the river that was described in the Hughes patent as being near Huddlecey's fence. Although this Robert Carter was involved in several other land transactions, he remained on this parcel until his death in 1759 when this parcel of land was devised to his son Charles.

    3. On 2 Nov 1726 Thomas Carter signed a will that recited:
    To eldest son Robert , 1 yearling cow
    To 2nd son Thomas , 1 yearling cow
    To son John , 1 shilling
    To son Edward, 1 shilling
    To daughter ElIzabeth Carter, 1 shlillng
    To son Joseph, all land I live on, 100 acres, but if he dies without Issue, then to my son Edward.
    Personal estate to wife Penele, and she to be executrix.
    The will was signed with a full signature and was witnessed by: Thomas Edwards, William Pledge, Dorothy (0) Pledge.

    4. On 18 Nov 1729 Robert Carter of St James Parish, Goochland Co, deeded [DB 1/144] to Susannah Hulsey, widow, of same Parish, for ?30 , 100 acres of land on north side of James River between land of Henry Atkinson and John Webb, with all houses, etc, being land where Charles Hulsey did formerly dwell. Mary wife of Carter relinquished her dower right [OB 1/177]. The deed was signed with a mark ? and witnessed by: John Webb and Joseph Ashlin. In a deed recorded on the same day Susannah conveyed this land together with another 100a to son Charles Hulsey. She signed this deed with a mark.

    Thomas Carter Jr.'s Last Will and Testament was written 14 February 1760 and was recorded in Goochland County on 19 April 1763. If his sons were named in chronological order, his oldest would have been Thomas [III], then John, then Josiah, then Baynes. In his Will, Thomas Carter refers to his ?Youngest sons, that is to say John Carter, Josiar [sic] Carter, and Baynes Carter.? He also refers to his wife Mary Carter. Mary may have been Mary Kilpatrick based on the 1751 marriage recorded in the Douglas Register for Thomas Carter to Mary Kilpatrick.

    ?In the name of God Amen, February 14th, 1760:
    ?To my Dear beloved son Baynes Carter the land I now live on containing 225 acres with my house and plantation also one middle sized Rone mare with a white spot in her face. . .she and her increase forever also one new man's saddle and bridle.?

    Beginning in the early 1770's, there was a migration of families from the Goochland County and surrounding area to southwest Virginia. Descendants of these families (Carter, Atkins(on), Dillon, Callaway, Tatum, Anthony, Bowman, Stoval, and others) can still be found in the beautiful and remote hills of Patrick and Henry Counties today. Baynes Carter and his brothers Josiah and John, third generation Carters, were among the early settlers who made their way south and west for better opportunities and more productive land.

    A 1773 Goochland County deed shows Baynes Carter and his widowed mother Mary, now of Pittsylvania County, selling their home place to Samuel Coleman Morris. Beginning a year or so prior to the sale of the Goochland County home place, Baynes, Josiah and John had begun to leave records in Pittsylvania, Bedford and Henry Counties.

    In August of 1774, records show that Baynes Carter, about age 18 or 19, received pay for 82days service under Captain Abraham Penn in the conflict between the Colony of Virginia and the Native Americans of the Ohio Valley. This conflict, Dunmore?s War, was named for the Royal Governor of Virginia, Lord Dunmore, who organized a large militia to ultimately prevent the Delaware, Mingo, and Shawnee from settling or hunting south of the Ohio River. John Carter, an elder brother of Baynes, served in this conflict as well.

    Just three years later, Baynes Carter (age 22) and his brother Josiah, along with other citizens of Henry County, Virginia, were called upon to renounce their allegiance to Great Britain and swear their allegiance to the Commonwealth of Virginia. Their signatures appear on the on 30 August 1777 list of Edmond Lyne, Esquire. This demonstrates that both men supported the impending Revolution and qualifies their descendants for membership in the Sons and Daughters of the American Revolution. Josiah is also recorded in the Virginia Publick Claims for Henry County as being reimbursed for provisions supporting the war:

    Monday, 06 May 1782: 5s-6 for 3 diets, 1 bu corn, 1 peck do. Furnished Hugh Armstrong on march to General Greene with county lead; 4s-6 for 150 bundles fodder furnished Jacob Gore quarter master Genl. 1st Regt, Light Dragoons; 10s for 4 bu corn meal furnished a guard with British prisoners on march from the southward to Winchester; 12s for 3 bu rye for 4 teams on return from Charlotte in North Carolina to Peytonsburg by cert. from Wm. McCraw ADQM.

    Friday, 24 May 1782: 42s for a saddle impressed for hospital at Henry Courthouse & lost.

    Few records have surfaced on Baynes Carter but we know that he purchased ?sundries? at the estate sale of John Hail in Pittsylvania County (Inventory recorded 26 September 1774). He also served as a guard for his county in 1777: ?Henry County Levy is made to Baines [sic] Carter, guarding, same 5 days.? On 21 July 1778, Henry County deeds show Josiah Carter conveying and selling to his brother Baynes 89 ? acres of land crossing Little Reedy Creek and Reed Creek to the mouth of said creek on Smith River. Over the next few years, several other Henry County land transactions are recorded concerning Baynes Carter. In 1780, Josiah Carter transferred some of his Reedy Creek property to his brother Baynes due to damages sustained by Baynes resulting from a grist mill operation. [This land is located near the present-day intersection of Route 220 and State Route 57 between Bassett and Collinsville, Virginia. Josiah Carter?s grist mill was still standing there as of !
    1920.] About the time Josiah Carter transferred the Reedy Creek property to his brother Baynes, Josiah, along with a contingent of other Henry County, Virginia, families, migrated farther south to the state of Georgia.

    It?s not until a land transaction on 24 June 1784 that we learn Baynes Carter has a wife: Baynes Carter and his wife Martha sell 221 ? acres of land on Reed Creek to George Hairston*. To date no marriage record or bond has been found and Martha?s surname remains unknown, but other records conclude that Baynes and Martha had been married at least 10 years by this time. In 1788, just a few years after the sale of the 221 ? acres of land, Baynes Carter passed away, leaving a widow and a son Jesse, age 13.**

    197 Samuel Carter who was named as one of the trustees was a
    son of Theodrick (Second) and Anne Carter. Samuel's brother Waddill married Mildred, a daughter of James Wade, who was also named as one of the trustees for widening the river.

    Mildred Wade married Waddill Carter c.1765. They had five children together: 1. James Carter 2. Theodrick Carter 3. Elizabeth Carter 4. Mildred Wade Carter, who married Anderson Wade in 1799 (See note from Carol Clemmer) 5. John Carter. Waddill died in 1782 and Mildred remarried in 1790 to Robert Anderson. Apparently, Robert Anderson died in 1802 and Mildred Anderson remarried AGAIN to Joseph Lewis in 1803 (as detailed in Anderson's estate papers).

    Waddill Carter married Mildred, likely Mildred Wade. Virginia reimbursed Carter for bacon and beef he provided during the Revolution. Milley was head of a household of nine whites in Prince Edward County in 1785. She married second Robert Anderson 19 April (bond) 1790, and third, Charles Joseph Lewis 9 October 1803.

    I'm going to include, tentatively, William, John, Charles & Joseph, who appear frequently on deeds with Giles in Halifax Co. They may be sons of Giles III.

    Giles was literate -- he signed his name on documents. Lila Hagerty has seen a true copy of one of his documents, and she commented on his beautiful signature. It appears that his sons all signed with X.

    1 AUG 1694 - Giles I acknowledged deeds of gift to his sons, Giles II & Theodorick

    14 DEC 1699 - His father's will gave to Giles "one mare called Nanny with her increase forever, it being a mare formerly given to him by William Sewell she then being but a Philly." After other specific bequests, the remainder was to be "divided into two parts, the one part whereof to belong to my wife Hannah and the other to my son Giles. It not being my intent or design'd in any wise hereby to disannull or make void a deed of Gift formerly by me made to my son Giles and entered upon Record. But I doe by this my last will and testament rattifie and confirm the same. It is my will and desire that what Estate shall appertain to my son Giles that he may receive the same when he shall arrive at ye age of eighteen years; and also enjoy the benefit of his Labour, my wife Hannah not being any wise mollested or disturbed upon the plantacon wee now live upon during her life." pp 55/56 2

    have another plantation in James City Co., which also descended to said Mary and Elizabeth from
    John FLOWERS, their uncle on their mother's side. Obediah and Mary SMITH are to have the
    plantation in Henrico Co., on Turkey Island Creek, and joining John PLEASANTS mill and
    lines of Richard POVAY, John COCKE'S and Giles CARTER, now in possession of John AST and

    5 DEC 1735 - Giles Carter was appointed to a Henrico Co. processioning board, "In obedience to an order of the Vestry of this parish, and according to the directions of an act of Assembly entitled an act for setting the titles and bounds of land and for preventing unlawful shooting and ranging hereupon;.........." p 64 2

    3 MAR 1736 - Giles signed the processioner's report. Among the lines processioned was those between John Cocke and Giles Carter. 65/66 2

    AUG 1736 - Giles Carter presented the inventory of the estate of John Webb to the Henrico Co. court. John Webb's April 1736 will was witnessed by Theodorick & John Carter and James Cole.

    [In Edgecombe Co. at the same time were Ralph HUDSPETH (son-in-law of Giles II) and his sons Ralph, Giles, and Carter; also Philemon BRADFORD, who also came from Charles City Co., VA]

    Note 1 Birth date of Giles II(1681-1686):
    Giles II was under 18 on 14 Dec 1699 when his father's will was executed; he was to receive his share of his father's estate at age 18. Therefore he was born after 14 Dec 1681. He received a deed of gift from his father 1 Apr 1686. The law allowed females to marry at 12 and males at 14. Males could possess land at 16, but not own it until 21. Guardians were required for orphans under 21, who could choose their own at 14.

    In 1704 Giles II, who was underage, requested the appointment of Wm. SEWELL as his guardian. By 1711 he must have been 21, because he recorded two land transactions. [These two items suggest a possible 1690 birth date, but we already know Giles was living on 1 April 1686.]

    Most researchers suggest that Giles II and Mary Povall were married between 1700 and 1702.
    [I?m guessing at a 1702 marriage date, and birth dates of 1685 for both Giles and Mary.]

    Note 2 Death date and place of Giles:
    Giles Carter of VA says that Giles was in Henrico Co. at least until 1736, that no will had been found, and that his death date was unknown. p 77 says that the Carters of this family who remained in Henrico Co. were descendants of Giles II and his nephew, John, the son of Theodorick I. Some Southern Colonial Families p 141 4 Giles died about 1760 in North Carolina

    Giles and son Giles Jr. (X) appear as witnesses in 1743 and 1744
    Giles and wife purchase 250 acres in 1744 and sell it in 1748. Robert witnessed the 1744 deed.
    .Other Carters witnessing deeds were James (1746, 1753 & 1754); Joseph (1754)

    From Edgecombe Co., Granville was formed in 1746 and from Granville, Halifax Co. was formed in 1758. In 1760 there are two deeds for Giles Carter Jr (X). I interpret that to mean that Giles, Sr. was also there on 16 June and 6 Dec. 1760. After that date there was no Jr.
    Note 3 Children of Giles Carter II and Mary Povall:
    There are many opinions regarding the children of this family.
    The only child I'm sure of is Mary, who married Ralph HUDSPETH II.

    A. It was Gen. Wm. G. H. Carter of Kentucky who gave us his John of Halifax - with descendants to Kentucky and points west - through Giles of Henrico. (Haplogroup I - based on just one test).
    B. It was Randolph A. Malone of 1989 Georgia who gave us [Patriot] Josiah Carter and His Forebearers through Thomas of Goochland. (Haplogroup Q - from several tests). Malone was the first to suggest a "close family tie" between Thomas and Theodrick.

    Holly Carter Dunlap (a/k/a Holly Hampton) reports / sorts the Carter Cousins Kits - most Kits have no ancestry. She first identifies Kit No. 23874 of Haplogroup I which ancestry parallels the Gen. Carter genealogy - too early to comment. Holly, an outstanding researcher, descends from Charles of Oglethorpe:

    Elizabeth on 22 Aug 1736 -- one month after Theodrick's will was executed; he was over 60
    years old. How old was Elizabeth? Was she the mother of all of the children?
    It's unlikely that Elizabeth, born in 1736, was the Elizabeth MARTIN named in her mother's 1747 will.

    Theodrick Carter sold his land willed to him by his father March 2, 1701 to John Pleasants. The land was called "Low Grounds" lying on the north side of the James River on "Run of Turkey Island Creek" for 10,000 pounds of tobacco. At the same time, he bought from the same John Pleasants, the property known as "Round Hills" on the south side of the Chicahomoniny Swamp. Theodrick Carter's will was executed July 22, 1736 and probated at the court held at Varina the first Monday in April, 17 37 at Henrico County, Virginia. In his will he gave to his son, Theodrick Carter, Jr. a small plantation of 218 acres.

    His will dated 22 Jul 1736 and entered into probate in the April term of Court in 1737:

    In the name of God amen I Theodorick CARTER of the parish and county of Henrico being sick but of perfect memory do this twenty second day of July one thousand seven hundred thirty Six make this my last Will and Testament
    First and principally I commit my Soul to Almighty God in [illegible] and by whose mercy and [illegible] of my Blessed Saviour and redeemer Jesus Christ I [several illegible words] my body to the earth to be decently Buryed at the discretion of my executrix hereafore named and as for Dispossing my Estate I give and Devise the same in the manner following:

    I give and devise unto my Beloved wife Elizabeth as long as she shall live my plantation land and appurtanances and after her death or Marriage I give unto my son Theodorick CARTER ahdn his heirs my plantation with two hundred and eighteen acres of land.
    I give and devise to my son John, one hundred and twenty acres beginning at a Birch standing on Roundhill Branch thence along a line of marked trees to [illegible] dividing line between Henry Spears and his land to a [illegible] oak on the farther side of the road then along the line of John Webb to a [illegible] Chickahominy Swamp thence [illegible]. My wife is not to be excluded from this land so long as She shall remain Solo, during which time I give her my Negro named Will and after that time I give him to my son Theodorick with negro child named Dick. I give unto my son John and his heirs after the death or marriage of his Mother, my Negro woman Judith and a mullato girl named Lucy with what children she may have [illegible] he has a right to the possession of one. I give unto my said son John another bed, rug and [illegible] great Chest, pot and Hooks and two Cows.

    Giles 1584 Lower Swell - 1664 Cold Aston - Died Without Issue

    Before we delve into the details of Giles Carter of Henrico instant, we need to sort and correct the record that has created havoc and confusion for many years, nay for decades. With absolute certainty ... and contrary to everything you have seen, the Giles who married Tracy had no children, never mind Giles instant. With a fair amount of certainty ... and contrary to Gen. Carter, the father of Giles of Henrico was not Giles, rather Theodor of Cirencester. With high probability ... and contrary to Dawson, Giles of King George County was a refugee from the religous strife across the river in Maryland, whose origins in England are still open to discussion. This is all from the superb work of others, we are just collecting, sorting and reporting the results.

    An Introduction to Gloucestershire from Joe Carter on Genforum: " ... you are correct in saying that the Giles Carter married to Elizabeth Tracy was associated with the Tracy's before his marriage to Elizabeth. His Father John Carter's wife Mary Lawrence was the daughter of Robert Lawrence and Eleanora (Elinor) Stratford , Eleanor Stratfords Father Was John Stratford that was married to Margarett Tracy daughter of William Tracy , John Stratford's sister Alice was the Wife of Edmund Broadway , John Stratford's sister Margaret was the wife of Edward Baugh". It is separately proven that Paul and William Tracy (old spelling) were first cousins from Toddington and were quite active in the tobacco industry in both Gloucestershire and Virginia.

    "I have been researching Giles Carter and family since 1975. In the late 70's my father and I went to Cold Aston and to research England. My father, who was a student of history and it was important to him that we be accurate in our findings. In Cold Aston we visited a church which we had heard about from a cousin who had been to England in the 60's. This little church has a plaque high upon the wall opposite the doorway. It reads as follows:

    "Anno Dom 1664--Giles Carter the eldest son of John Carter of Netherswell
    Co. of Gloucester, Esq. his two brothers being John Carter of Charlton Abbots
    and William Carter of Bressnorton in Oxford married Elizabeth the daughter of
    Paul Tracye of Standwell and DIED WITHOUT ISSUE." Capitalization my own.

    "There are many plaques in various corners and my father and I also saw this one in a dark corner. It reads: "In memory of the noble Giles Carter formerly of Lower Swell in this County, Esq., who by probity of manners, faith and piety in divine things and also in the Prince, was famous among the poor in pious old age closing his life died in the 80th year of his life the 24th of March in the year of our Lord 1664, and there preceded him by eight years, his dear wife, Elizabeth, descended from the honest and splendid of Tracy, who together with him lived for 60 years of marriage and both will not be separate again in the Celestial Kingdom."

    Joy continues with the "Abstracts of Records and Manuscripts Respecting the Co. of Glouster;
    Formed into a History, Correcting the very erroneous accounts and Supplying Numerous Deficiencies
    in Sir Robert Atkyns and Subsequent Writers," by Thomas Dudley Fosbrooke Vol.2, 1807....

    " ... in 1590 John Stratforde of Farcote, conveyed (his estate) to John Carter of Pyrton,
    in Churchdown. Giles, his son, by will dated 1664 devised to Edward his nephew and
    his heirs male, remainder, in default of such issue, to his nephew Goddard, in fee.
    Goddard devised to his daughter Rebecca, in fee, who married Sir John D'Oyley."

    " ... for years and years researchers have tried to make Giles the son of Giles and Eliz. Tracy. But as you can see, it simply cannot be so. Giles 1634-1701 MAY be of the same family by some other relationship but .....

    he cannot be a son of Giles and Elizabeth". [Our emphasis].

    Joy has been fighting a losing battle on this for the past five years and we thought we would now make it very, very, very clear. (Yes ... and how clear is that?) We now have a minor task immediately in front of us to prove the John Carter of Pryton in 1590 is the same as our John of Lower Swell in 1606 and later; Churchdown is an eastern suburb of the City of Gloucester, while Badgeworth is about half way over to Stow-on-the-Wold, where the three different Swells and Cold Aston are then found. Joe Carter [see GenForum No. 15353] sent us the Inquisiton Post Mortem of John Carter of Lower Swell at Tewksbury on 4 April 1628. It would appear that Paul Tracy, Esquire later Baron, provided the manor at Cold Aston as a wedding gift in the three party indenture of 1606. The date of this transaction alone places the date of birth of Giles of Cold Aston before 1585 and nothing like the date of 1604 from the books.

    "So seized [legally owns], the said John Carter and Giles Carter, his son and heir
    apparent, by indenture tripartite, dated 18th January 3 James I [1606], and made
    between him, the said John Carter, and Mary his wife of the one part, Paul Tracy,
    then esquire and afterwards baronet, and William Essex, gentleman, deceased,
    of the second part, and the said Giles Carter and Elizabeth Tracy, one of the
    daughters of the said Paul, and now the wife of the said Giles, of the third part ....."

    In plain English, immediately after payment of a fine, John Carter of Lower Swell and
    his son Giles shall become the legal owners of the manor at Cold Aston, etc. and enjoy
    the premises for life but without the lands .... "After the said Elizabeth Tracey for life,
    as part of her jointure and dower" .... and after her death, to John and all heirs male".

    The Constant Movement of Carters of Gloucestershire

    Annotations: 1) Paul Tracy was Knighted after 1606 but before 1627 (now proven to be in 1611), 2) allow us to emphasize the phrase " .... and now the wife of the said Giles", 3) Giles is an active, legal participant of this transaction, 4) it says Dowry! As an aside, this Inquisition demonstrates that the Indenture Tripartite was the standard legal form of the day to pass a Dowry not only to the new son-in-law, but to the whole of his family. This in turn explains the contant movement of our Carter of Gloucestershire. Separately, the very last entry of the whole of this Inquisition is misleading in stating "Giles Carter is his son and heir, and was then aged 30 years or more". (In 1627) Whatever the provisions, Giles of Cold Aston was a legal adult in 1606! They married sometime in 1605!

    Did you notice, for example, that the second plaque at Cold Aston proves the birth of Giles instant in 1584?

    " ... closing his life died in the 80th year of his life the 24th of March in the year of our Lord 1664"

    But then, typical for memorial plaques on both sides of The Pond, Giles and Elizabeth could not have been married for 60 years, could they? Given all the above, it was Giles who lived for another sixty years after the marriage, Elizabeth for only fifty-two years. Once more with feeling, the 1606 transaction was a wedding gift, only back then it was called a Dowry!

    The Inquisition then recites two other three party indentures. In 1611, by perfect analogy to the first, said John Carter passes legal ownership "in Charlington, Cothey and elsewhere" to his son John Jr. and his wife Anne, daughter of Eustace Darcy, Esq. (This is an example of why any given child - especially the oldest - may be missing from the later will of the father). In 1622, said John Carter passes legal ownership of lands and houses in the parish of Blockley in the county of Worcester to his nephews who have somehow married into the families of Edward Goddard, Esq., Sir Giles Fettiplace and Edward, son of Edward. That will be a matter for a separate enquiry of a later date; meanwhile, see the Joseph Carter Introduction above, together with the 1590 citation for John Stratforde of Farcote.

    The Fatal Visit of 1620

    Otherwise, there is very little known about the life of Giles of Cold Aston. Gen. William Harding Carter in his 1909 book accurately describes the 1620 visit of the Carter and Tracy on pp. 32, 33, and yet, he is the singular source of the error for two Giles to be the father and grandfather of Giles instant! The plaque with both names and the three party indenture of 1606 proves this is our Giles of Cold Aston:

    "The first Giles Carter of whom there is any record in Virginia, came from Gloucestershire,
    England, with William Tracey on the Supply, which sailed from Bristol, September 24th, 1620
    (O.S.) and arrived at Berkley January 29th, 1620 (O.S.). After looking over the situation
    Giles Carter returned to England immediately before or just after the Indian massacre of
    Friday, April 1st, 1622. The Carter family of Goucestershire, England, in which Gyles or
    Giles appears as a Christian name, was connected with the Tracey family by the marriage
    of Gyles Carter and Elizabeth Tracey. This Giles was a son of John Carter of Lower Sewell,
    who was High Sheriff of Gloucester in 1612." [sic for the spelling of Tracey]

    The last statement is proven beyond all doubt by the Inquisition of 1628 at Tewksbury. However, there
    is a second version of these events: Given the other errors, can we trust 1642? Of course not, read the plaque! This entry merely gives us more of the Tracy relatives, and at the same time, demonstrates the false data we have had to live with for many years: Giles Carter: Birth: 1604 in Swell, Gloucestershire, England Death: 1642 in Gloucestershire, England

    "Giles Carter came to Virginia with his uncle and aunt, William and Mary Tracy, his first
    cousins, Joyce and Thomas Tracy. They sailed on the ship "Supply" out of Bristol,
    England destined for Berkely Hundred on 9/25/1620. After the massacre of the settlers
    by Indians in 1620, Giles with his cousin Thomas Tracy returned to England. Giles'
    cousin, Joyce and her husband Captain William Powell were killed in the massacre.
    Giles remained in England, but his son Giles and his wife Hannah returned to Virginia."

    In The Matter of The Books Before Us

    Can we trust the information on the cousins with the ludicrous last statement? Giles of Henrico wasn't even born yet .... Giles of Cold Aston was sentenced to death in 1666 ... The hand written notes of John Smythe records the death of William Tracy on 8th April 1621. etc.etc.etc. On the other hand, it is well documented that William Tracy was a first cousin of Paul (three times removed) and had petitioned the Crown for the establishment of the Berkely Hundred and had organized the whole of the trip. (See final section below). This confused entry appears to be from Dawson, the same source who said Giles instant removed to King George, and there is some very good information and some very poor information in this same paragraph, isn't there? Need we say more?

    A partial answer to the confusion of the dates of the massacre, however, is found on the GenForum of Wesley Tracey of 18 Nov 2003: "...The question of the ancestry of Lt Thomas Tracy of Norwich, CT has been researched by many many people but the question has not been conclusively resolved. Early in the last century, a Dr. Dwight Tracy proposed that he was the son of "Governor" William Tracy of Virginia and had a single sibling, a sister, Joyce. In the book, "Virginia Historical Genealogies", 1975, by John Bennett Boddie, William Tracy is shown as having been appointed, along with one George Thorpe, to govern the colony of the Berkeley Hundred in Virginia. Captain Tracy and his wife were slain by Indians on 6 April 1621. Their daughter Joyce and her husband, Capt Nathaniell Powell, were killed the following year in an Indian massacre on 22 Feb 1622. "Thomas Tracy, son of Capt. William Tracy, survived and returned to England." There is speculation that he grew to maturity in England and later returned to New England to become our ancestor, Lt Thomas Tracy of Norwich".

    See the final section below for the Joseph Carter Hypothesis on the possible connection between the two Giles; even though Henrico is conveniently just up-river from Jamestown, it is curious the two Giles Carter from Gloucestershire arrived in Henrico. Joe alleges both sets of Carter instant married with the Stratford, but that will be a separate matter at a later date. On the other hand, contrary to Dawson, Giles of King George is a completely different person and family, probably a refugee from the religous strife across the river in Maryland! Dawson is frankly right behind Dr. Miller in making false assumptions and erroneous connections to the Carters of Colonial Virginia. Once and for all, the two sets of Carter from Gloucestershire are now clearly identified:

    Giles m. Tracy was born 1584 to John (married 1605, visited Henrico in 1620, died in Cold Aston in 1664)
    Giles m. Rowen and Crews was born 1634 to Theodor (arrived 1653, first marriage 1660, second 1675)

    Once more with feeling .............. Throw The Bloody Books Away!

    Giles 1634 Cirencester - 1701 Henrico - An Unlikely First Cousin

    [For consistency, we use the dates of christening for all the children of Theodore - common sense then says to deduct a month or two for the actual date of birth].

    " I have received confirmation from the records office in Gloucestershire, England, of the baptismal record of Giles Carter, who immigrated to Henrico County, Virginia. Here is the actual reply I received:

    "A member of staff checked the baptism register for the parish of Cirencester (P86) for the year 1635 and I can confirm that the baptism of Gyles, son of Theodor [?Theodore] Cartor is recorded. The spelling of names was not standardised until fairly recently and so the slight difference in spelling of both the christian and surnames is not significant."

    Apr 1680 Deposition of Giles CARTER, aged about 46. p 143 (Order Book & Wills 1678-1693, p 57)

    Lavere Peters on her RootsWeb proves we have the correct Giles (Gen. Carter confirms the deposition):

    "A more likely theory for the father of Giles is Theodor CARTER who,according to the IGI for parish records of Cirencester, Gloucestershire, England, had a son Giles born in 1634 and christened 24 April 1635. That birth date coincides with Giles's 1680 deposition, in which he declares himself to be 46 years old. Also, our Giles CARTER named his first son Theodrick. [touche .... only, of course, if you realize his father was not Giles]

    "I suspect that Theodor CARTER may have been related in some way to the Giles CARTER who made a trip to Virginia in 1621 [** see above] and/or to Gyles CARTER, Esq. of Cold Aston; so we may still latch onto some of the medieval folks. The children attributed in the IGI to Theodor are Mary, Giles, Joane, Elizabeth, and Margery".

    We now have proof the visitor was the same Giles of Cold Aston, accompanied by his aunts, uncles and cousins from the Tracy. As an aside, during our search for the visitor, we discovered RootsWeb postings that cite several Carters/Giles jumping over from Maryland during it's "religous strife" of the 17th century. From our earlier work on both branches of the Carters of Lancaster, we know the Brent estate at Aquilla, Stafford County is a singular example of the migration. It was settled by William Brent who was the first Catholic in Virginia, and subsequently owned by Robert King Carter but managed and operated by his cousins and nephews from Capt. Thomas Carter. The refugees from Maryland could well be the source for Giles of King George, which of course sits right on the Potomac River, upstream and right next door to Northumberland which is proven to be the first place of refuge. And, by the way ..... Stafford sits right above King George ..... on the Potomac.

    The Two Marriages of Giles of Henrico - Probably

    This is the date of the patent, there is no clue as to when the fifteen persons actually came over; although it is not proof in the strict sense, this would be our Giles instant in that he would be at the "perfect age" of eighteen. Merely by common sense, he would then serve his indenture for a few years and first marry by 1660. (There are random and unproven statements that the indenture was in fact for three years).

    Henrico Co., Va. Patent Book 3, page 192:
    Mr. William Fry, 750 acres near the head of Chichamony River on SW side thereof, 7 April 1653. Beg. at Fleets quarter including a small indian field, for transporting 15 persons: Giles Carter, Ralph Spendlowe, Jane Walker, Miles Noble, Anne Williams, William Brooke, Ralph Burton, Andrew Miller, Alice Archer, the said Fry's wife and his three children, Dorothy Miller, William Hoccadie(?Hockaday).

    The Randolph A. Malone book "Josiah Carter: His Forebears, Descendants and Allied Families", (Grandson of Thomas Carter Sr. who is currently styled as Thomas of Goochland) appears to answer the confusion over Hannah. After his presumed indenture with William Fry who was on the northern border of Henrico County, our Giles would have been a Free Person and eligible for marriage circa 1660 at age twenty-five:

    "It is likely that as a young man Giles Carter was married to a daughter of John Rowen, since in a 1662 will he left the use of his house and land on a plantation to Giles for a year. Shortly thereafter Giles was well established in the eastern end of Henrico Co. near the Charles City Co. border. By 1676 he was married to Hannah Crewes, daughter of James Crewes". etc.

    Bill Husler cites the same will but goes on to provide excellent follow-on connections in his RootsWeb (database-billhusler). First off, Bill is another rare researcher, together with Ms. LaVere Peters, who frequently uses alleged, proposed and possibly at the appropriate time. Yes, there are several other transactions to show they were in the same area, but what evidence is there for Giles instant to be in the employ of Capt. James Crewes, Merchant?

    "1 May 1662 The will of John ROWEN of Henrico Co gives Giles CARTER a cow and the use for one year of a house and land on Rowen's Turkey Island estate. 2 John ROWEN was the stepfather? of Daniel and John PRICE; Daniel PRICE later married Susannah, daughter of Giles CARTER. One of the witnesses of this will was Margaret CREWS, daughter of Daniel LLEWELLYN and considered by some to have been the wife of James CREWES; if so, she must have died before 1676.

On the other hand, there is nothing to say he was not first "properly" married to Margaret Llewellyn!

    "Before 1676 Apparently Giles CARTER was employed by, or associated with, Captain James CREWES who owned a large plantation in Henrico. Crewes was a merchant and acted as agent for Daniel LLEWELLYN

    And then, Bill provides one possible answer to our concern about the apparent disparity between the two sets of Carter from Goucestershire, both of whom married with the Stratford according to Joe Carter: one set arranged a whole passage, while Giles instant had his passage paid for. Wouldn't the following also set the stage for the Sentencing of a (cousin) Giles of Cold Aston in 1666? (Remember, Giles m. Tracey died in 1664)

    Yes, but how does this explain the fact that William Frye paid for the passage of our Giles? For example ...... should we consider the following, given it has the correct early details and separates the two Giles Carter of Gloucestershire? {No source cited). Our basic question remains unanswered, but would a horse thief turn out to be a rather successful businessman of his own?

Itis my will and desire that what of my Estate shall Remaine (one fether bed and furniture only excepted) for my wife hanna (which I give unto her) may be equally divided into two parts, the one part whereof to belong to my wufe Hannah the other to my son Giles. it not being my intent or design in any wise hereby to disannull or make voide a deed of Gift formerly by me made to my son Giles and entered upon Record.     Possible First Cousins - Did Both Sides Marry Stratford?

    Yes, it is intriguing that both Giles Carter instant came from the same general area of Gloucestershire and arrived in Henrico. However, there appears to be a wide disparity between the two as noted above ... and yet ... look at the flow of the names in the second column! A summary of the Joseph Carter Hypothesis (first column proven, second column guesses down to Theodor). These are all in Gloucestershire, just several miles from each other to the immediate west of Stow-on-the-Wold:

    Gen 1: Giles of Badgeworth d. 1585 ............. mentions brother Thomas of Badgeworth, n.f.i.
    Gen 2: John of Nether Swell d. 1625.............. Thomas 2. or Robert 1. ........ these really Raise the Ante

    The ancient Roman town of Cirencester is some twenty miles southwest. Thing is, Joe has dug up another Three Party Deal to show that Lucy Tracy, another daughter of Sir Paul, was married to Bray Ayleworth in Cirencester! Curious ..... tantalizing ..... but we still need a Carter to Stratford marriage in Cirencester!

    yadda, yadda, yadda .... dozens of descendants ..... he confused himself! John the Elder of Charlton Abbots was a son of John of Netherswell per his last entry above. There were subsequent nephews named Giles but they were not the ones to marry Tracy!

    4. John Carter of Charlton Abbotts the younger had sons named John and Gyles [** see LaVere Peters - since Theo as father of Giles instant is now rather proven, this would appear to be an uncle of Giles of Henrico] from the will of the older John

    In 1530, Sir William Tracy left a heretical Will, whereby he relied for his salvation on faith rather on the prayers of the Monks.

    The marriage of the Tracy daughter to John Stratford of Farmcote built a long lasting relationship with business and friendship, and, together with Richard Tracy, John Stratford assisted in the Dissolution of Hailes Abbey. Richard's father being brought up at Bushley, by the Stratford's.

    Richard Tracy acquired Stanway, at the Dissolution and his son Paul was created Baronet in the Reign of James the First, ( 1603 - 1625 ) and eventually passed to a younger son of Toddington. It is presently in the possession of the Earl of Wemys and March, who has a Tracy Pedigree.

    William Tracy of Hailes, who was involved greatly with the Stratford's of Bushley, was one of the first to help in the Colonisation of America, through his connection with the Virginian Company and in the year 1620 Sir Paul was in partnership with John Stratford of London, growing tobacco in the Winchcombe area of Gloucestershire.

    The Tracy Family history is a book on its own, and I will not attempt to pursue it further, except to state that when the Stratford family became financially estranged at Farmcote, it was Robert Tracy who bought the estate. Today's representative of this great Family is the Baron Sudeley.

    Sir Paul Tracy, who succeeded to the manor of Stanway. He was created a baronet June 29, 1811,
    [ ....... 1611 of course ..........] by King James I., "being the thirteenth created from the institution of the order." He married first, Anne, daughter and heiress of Ralph Sharkeley, of Ayno-on-the-Hill, County of Northampton. They had twenty-one children.

    The ancient manor of Stanway in the Cotswolds was presented to Tewkesbury Abbey in the year 715 by two Mercian leaders Odo and Dodo. It was the first and only remote property owned by the Abbey until the 12th century when land was acquired in Dorset. Stanway supported four monks.

    In 1533 Richard Tracy, the younger son of Sir William Tracy of Toddington obtained the lease of the manor from Abbot Segar. Richard is known to have led the commission that dissolved Hailes Abbey and it was around this time that he was able to purchase the freehold to Stanway. It was his son Paul who rebuilt the house incorporating some of the early Tudor house in it. This work started in about 1580. Paul Tracy was created Baronet in 1611 and died in 1620. His son, Sir Richard Tracy, continued building and it was he who had the magnificent gatehouse erected in 1630. He died however in 1637.
