Vestry Book of Antrim Parish, Halifax County, Virginia 1752-1817. At a Vestry held for Antrim Parish at Halifax Courthouse the 24 August 1767. Page 108 ? Pursuant to an order of the County Court of Halifax bearing date the 17 July last past for this vestry to appoint Processioners according to law whereupon it is ordered that John Lawson, John Mount and John Carter do procession the bounds of every particular person?s lands between Miller?s Road, Burches Creek, the County line and Dan River and it is further ordered that the Processioners aforesaid do begin their said work on the second day of November next and take and return to the Vestry on or before the last day of March next ensuing an account of every particular person?s land they shall so procession and the persons present at the same and what lands in their precincts they failed to procession and the particular reasons of such failure.

"The Willis River rises in southern Buckingham County and initially flows eastwardly into [southern] Cumberland County, where it turns north-northeastwardly for the remainder of its course. It flows into the James River in northern Cumberland County, about 6 mi (10 km) southeast of Columbia".

Amelia County is nowhere near the Willis - it's on the other (east) side of Cumberland:
The County, named for Princess Amelia, daughter of George II of England, was created by a legislative act in 1734, and in 1735, it was created from Prince George and Brunswick Counties. Then, in 1754, Prince Edward County was formed from Amelia County, and later the County was reduced to its current size when Nottoway County was separated in 1789.

* These three deed citations could be anywhere along the Willis - including the intersection with the James River - which is exactly where Carters Ferry (of Robert) is. Thing is, per the description of the river flowing North by Northeast, the only land truly north of the Willis River is in that small pocket up at the James River - where the Willis turns sharply East just before emptying into the James.

And yet, these are just deed locations - except for the 1743 citation, these do not tell us where the Theo in question was living at the time. We have many cases where in other lines where transactions were being conducted after the removal of the property owner.

A solid, continuous presence where the combined transactions of 1742 and 1753 prove the three transactions on the north side of the Willis River must belong to Theo Junior - in Amelia County by 1743 - and not the son of Giles Junior. And ... let's remember that the mother of Theo Junior is now proven to be Elizabeth Webb - per the 1741 transaction north of the Willis.

THEODORICK JR -3 married about the time his father died, somewhere around 1736 or 1737. John Carter-3 is mentioned in the will of their father to receive several basic household articles that were not given to THEODORICK-3 who appears to be the older of the two men, and was probably already married at the time the will was written. THEODORICK-3 received almost twice as much land as John-3 did, however, again reinforcing our belief that he is the older of the two. THEODORICK-3 married a woman named ANN, who is apparently the daughter of WILLIAM WADDILL. Her birth is recorded in the parish register as ?Ann Waddill, the daughter of William Waddill christened 24 January 1713? and recorded in New Kent. Since we know that THEODORICK CARTER-3 was born prior to 1706 we can see that ANN WADDILL was a few years younger than he was.

In witness whereof I have hereunto set my hand and seal this seventh day of December in the year of Christ one thousand seven hundred and seventy seven.

Agnes Watkins, the witness to this will, was the wife of Francis Watkins, one of the executors of the will. Thomas Watkins [possibly the father of Francis] had witnessed the will of THEODORICK-3?s father. Thus, more circumstantial proof that we have the right Theodorick Carter. The William Waddill who witnessed the will was probably not ANN?s father by that name, but most likely was her brother, nephew, or cousin. The will was probated January 19, 1778, in Prince Edward County. Francis Watkins, the executor of the will, was apparently a close friend or relation to the CARTER family. John Carter-4, the son of THEODORICK-3 named a son ?Francis Watkins Carter-5? and WILLIAM-4 also named a son ?Francis-5.? That Christian name has continued as an ?heirloom? name in this line of CARTERS ever since. This reinforces the supposition that ?our? WILLIAM is ?that William Carter.? Agnes Watkins?s sister was married to Nathaniel Venable, the co-executor.

The mention of the Negro slave, Dick, who had been inherited as a lad from THEODORICK CARTER-2 in his will is another piece of evidence that we have the correct Theodorick Carter.

The older children, Susannah-4, John-4, Theodorick-4, and WILLIAM CARTER-4 had apparently already been given their shares of the estate prior to the death of their father, THEODORICK-3, so they received only token bequests.

I'm going to include, tentatively, William, John, Charles & Joseph, who appear frequently on deeds with Giles in Halifax Co. They may be sons of Giles III.

Giles was literate -- he signed his name on documents. Lila Hagerty has seen a true copy of one of his documents, and she commented on his beautiful signature. It appears that his sons all signed with X.

1 AUG 1694 - Giles I acknowledged deeds of gift to his sons, Giles II & Theodorick
(Henrico Co. Col. Records, 2: 201) p 147 4

14 DEC 1699 - His father's will gave to Giles "one mare called Nanny with her increase forever, it being a mare formerly given to him by William Sewell she then being but a Philly." After other specific bequests, the remainder was to be "divided into two parts, the one part whereof to belong to my wife Hannah and the other to my son Giles. It not being my intent or design'd in any wise hereby to disannull or make void a deed of Gift formerly by me made to my son Giles and entered upon Record. But I doe by this my last will and testament rattifie and confirm the same. It is my will and desire that what Estate shall appertain to my son Giles that he may receive the same when he shall arrive at ye age of eighteen years; and also enjoy the benefit of his Labour, my wife Hannah not being any wise mollested or disturbed upon the plantacon wee now live upon during her life." pp 55/56 2

1704 - Giles, who was under age, had William SEWELL appointed his guardian (Henrico Co. Wills and Deeds 1697-1704, pp 256 & 279; (Orphan's Court Book 1677-1739, p 91) (See note 1) p 297 3

6 Apr 1705: Obediah SMITH and Mary his wife, of Henrico Co., to Lanslott WOODWARD
and Elizabeth his wife, of James City Co., said Lanslott and Obediah are siezed in right of their
wives, which descended to said Mary and Elizabeth from their father , William COCKE. They also
have another plantation in James City Co., which also descended to said Mary and Elizabeth from
John FLOWERS, their uncle on their mother's side. Obediah and Mary SMITH are to have the
plantation in Henrico Co., on Turkey Island Creek, and joining John PLEASANTS mill and
lines of Richard POVAY, John COCKE'S and Giles CARTER, now in possession of John AST and
Henry LESTER, 254 acres. Lanslott and Elizabeth WOODWARD to have the plantation in
James City Co. On Chickahominy river and Warring Creek, next to Bennett FREEMAN and

5 DEC 1735 - Giles Carter was appointed to a Henrico Co. processioning board, "In obedience to an order of the Vestry of this parish, and according to the directions of an act of Assembly entitled an act for setting the titles and bounds of land and for preventing unlawful shooting and ranging hereupon;.........." p 64 2

3 MAR 1736 - Giles signed the processioner's report. Among the lines processioned was those between John Cocke and Giles Carter. 65/66 2

AUG 1736 - Giles Carter presented the inventory of the estate of John Webb to the Henrico Co. court. John Webb's April 1736 will was witnessed by Theodorick & John Carter and James Cole.

[It seems likely that these might be Giles II and III, and perhaps other sons of Giles II.
[In Edgecombe Co. at the same time were Ralph HUDSPETH (son-in-law of Giles II) and his sons Ralph, Giles, and Carter; also Philemon BRADFORD, who also came from Charles City Co., VA]

Note 1 Birth date of Giles II(1681-1686):
Giles II was under 18 on 14 Dec 1699 when his father's will was executed; he was to receive his share of his father's estate at age 18. Therefore he was born after 14 Dec 1681. He received a deed of gift from his father 1 Apr 1686. The law allowed females to marry at 12 and males at 14. Males could possess land at 16, but not own it until 21. Guardians were required for orphans under 21, who could choose their own at 14.

In 1704 Giles II, who was underage, requested the appointment of Wm. SEWELL as his guardian. By 1711 he must have been 21, because he recorded two land transactions. [These two items suggest a possible 1690 birth date, but we already know Giles was living on 1 April 1686.]

Most researchers suggest that Giles II and Mary Povall were married between 1700 and 1702.
[I?m guessing at a 1702 marriage date, and birth dates of 1685 for both Giles and Mary.]

Note 2 Death date and place of Giles:
Giles Carter of VA says that Giles was in Henrico Co. at least until 1736, that no will had been found, and that his death date was unknown. p 77 says that the Carters of this family who remained in Henrico Co. were descendants of Giles II and his nephew, John, the son of Theodorick I. Some Southern Colonial Families p 141 4 Giles died about 1760 in North Carolina

Giles and son Giles Jr. (X) appear as witnesses in 1743 and 1744
Giles and wife purchase 250 acres in 1744 and sell it in 1748. Robert witnessed the 1744 deed.
.Other Carters witnessing deeds were James (1746, 1753 & 1754); Joseph (1754)

From Edgecombe Co., Granville was formed in 1746 and from Granville, Halifax Co. was formed in 1758. In 1760 there are two deeds for Giles Carter Jr (X). I interpret that to mean that Giles, Sr. was also there on 16 June and 6 Dec. 1760. After that date there was no Jr.
Note 3 Children of Giles Carter II and Mary Povall:
There are many opinions regarding the children of this family.
The only child I'm sure of is Mary, who married Ralph HUDSPETH II.

Giles 1584 Lower Swell - 1664 Cold Aston - Died Without Issue

Before we delve into the details of Giles Carter of Henrico instant, we need to sort and correct the record that has created havoc and confusion for many years, nay for decades. With absolute certainty ... and contrary to everything you have seen, the Giles who married Tracy had no children, never mind Giles instant. With a fair amount of certainty ... and contrary to Gen. Carter, the father of Giles of Henrico was not Giles, rather Theodor of Cirencester. With high probability ... and contrary to Dawson, Giles of King George County was a refugee from the religous strife across the river in Maryland, whose origins in England are still open to discussion. This is all from the superb work of others, we are just collecting, sorting and reporting the results.

An Introduction to Gloucestershire from Joe Carter on Genforum: " ... you are correct in saying that the Giles Carter married to Elizabeth Tracy was associated with the Tracy's before his marriage to Elizabeth. His Father John Carter's wife Mary Lawrence was the daughter of Robert Lawrence and Eleanora (Elinor) Stratford , Eleanor Stratfords Father Was John Stratford that was married to Margarett Tracy daughter of William Tracy , John Stratford's sister Alice was the Wife of Edmund Broadway , John Stratford's sister Margaret was the wife of Edward Baugh". It is separately proven that Paul and William Tracy (old spelling) were first cousins from Toddington and were quite active in the tobacco industry in both Gloucestershire and Virginia.

Throw the Bloody Books Away .... GenForum posting of Joy Carter Johnstone of 8 Oct 2002 .....

"I have been researching Giles Carter and family since 1975. In the late 70's my father and I went to Cold Aston and to research England. My father, who was a student of history and it was important to him that we be accurate in our findings. In Cold Aston we visited a church which we had heard about from a cousin who had been to England in the 60's. This little church has a plaque high upon the wall opposite the doorway. It reads as follows:

"Anno Dom 1664--Giles Carter the eldest son of John Carter of Netherswell
Co. of Gloucester, Esq. his two brothers being John Carter of Charlton Abbots
and William Carter of Bressnorton in Oxford married Elizabeth the daughter of
Paul Tracye of Standwell and DIED WITHOUT ISSUE." Capitalization my own.

"There are many plaques in various corners and my father and I also saw this one in a dark corner. It reads: "In memory of the noble Giles Carter formerly of Lower Swell in this County, Esq., who by probity of manners, faith and piety in divine things and also in the Prince, was famous among the poor in pious old age closing his life died in the 80th year of his life the 24th of March in the year of our Lord 1664, and there preceded him by eight years, his dear wife, Elizabeth, descended from the honest and splendid of Tracy, who together with him lived for 60 years of marriage and both will not be separate again in the Celestial Kingdom."

Joy continues with the "Abstracts of Records and Manuscripts Respecting the Co. of Glouster;
Formed into a History, Correcting the very erroneous accounts and Supplying Numerous Deficiencies
in Sir Robert Atkyns and Subsequent Writers," by Thomas Dudley Fosbrooke Vol.2, 1807....

" ... in 1590 John Stratforde of Farcote, conveyed (his estate) to John Carter of Pyrton,
in Churchdown. Giles, his son, by will dated 1664 devised to Edward his nephew and
his heirs male, remainder, in default of such issue, to his nephew Goddard, in fee.
Goddard devised to his daughter Rebecca, in fee, who married Sir John D'Oyley."

" ... for years and years researchers have tried to make Giles the son of Giles and Eliz. Tracy. But as you can see, it simply cannot be so. Giles 1634-1701 MAY be of the same family by some other relationship but .....

he cannot be a son of Giles and Elizabeth". [Our emphasis].

Joy has been fighting a losing battle on this for the past five years and we thought we would now make it very, very, very clear. (Yes ... and how clear is that?) We now have a minor task immediately in front of us to prove the John Carter of Pryton in 1590 is the same as our John of Lower Swell in 1606 and later; Churchdown is an eastern suburb of the City of Gloucester, while Badgeworth is about half way over to Stow-on-the-Wold, where the three different Swells and Cold Aston are then found. Joe Carter [see GenForum No. 15353] sent us the Inquisiton Post Mortem of John Carter of Lower Swell at Tewksbury on 4 April 1628. It would appear that Paul Tracy, Esquire later Baron, provided the manor at Cold Aston as a wedding gift in the three party indenture of 1606. The date of this transaction alone places the date of birth of Giles of Cold Aston before 1585 and nothing like the date of 1604 from the books.

"So seized [legally owns], the said John Carter and Giles Carter, his son and heir
apparent, by indenture tripartite, dated 18th January 3 James I [1606], and made
between him, the said John Carter, and Mary his wife of the one part, Paul Tracy,
then esquire and afterwards baronet, and William Essex, gentleman, deceased,
of the second part, and the said Giles Carter and Elizabeth Tracy, one of the
daughters of the said Paul, and now the wife of the said Giles, of the third part ....."

In plain English, immediately after payment of a fine, John Carter of Lower Swell and
his son Giles shall become the legal owners of the manor at Cold Aston, etc. and enjoy
the premises for life but without the lands .... "After the said Elizabeth Tracey for life,
as part of her jointure and dower" .... and after her death, to John and all heirs male".

The Constant Movement of Carters of Gloucestershire

Annotations: 1) Paul Tracy was Knighted after 1606 but before 1627 (now proven to be in 1611), 2) allow us to emphasize the phrase " .... and now the wife of the said Giles", 3) Giles is an active, legal participant of this transaction, 4) it says Dowry! As an aside, this Inquisition demonstrates that the Indenture Tripartite was the standard legal form of the day to pass a Dowry not only to the new son-in-law, but to the whole of his family. This in turn explains the contant movement of our Carter of Gloucestershire. Separately, the very last entry of the whole of this Inquisition is misleading in stating "Giles Carter is his son and heir, and was then aged 30 years or more". (In 1627) Whatever the provisions, Giles of Cold Aston was a legal adult in 1606! They married sometime in 1605!

Did you notice, for example, that the second plaque at Cold Aston proves the birth of Giles instant in 1584?

" ... closing his life died in the 80th year of his life the 24th of March in the year of our Lord 1664"

But then, typical for memorial plaques on both sides of The Pond, Giles and Elizabeth could not have been married for 60 years, could they? Given all the above, it was Giles who lived for another sixty years after the marriage, Elizabeth for only fifty-two years. Once more with feeling, the 1606 transaction was a wedding gift, only back then it was called a Dowry!

The Inquisition then recites two other three party indentures. In 1611, by perfect analogy to the first, said John Carter passes legal ownership "in Charlington, Cothey and elsewhere" to his son John Jr. and his wife Anne, daughter of Eustace Darcy, Esq. (This is an example of why any given child - especially the oldest - may be missing from the later will of the father). In 1622, said John Carter passes legal ownership of lands and houses in the parish of Blockley in the county of Worcester to his nephews who have somehow married into the families of Edward Goddard, Esq., Sir Giles Fettiplace and Edward, son of Edward. That will be a matter for a separate enquiry of a later date; meanwhile, see the Joseph Carter Introduction above, together with the 1590 citation for John Stratforde of Farcote.

The Fatal Visit of 1620

Otherwise, there is very little known about the life of Giles of Cold Aston. Gen. William Harding Carter in his 1909 book accurately describes the 1620 visit of the Carter and Tracy on pp. 32, 33, and yet, he is the singular source of the error for two Giles to be the father and grandfather of Giles instant! The plaque with both names and the three party indenture of 1606 proves this is our Giles of Cold Aston:

"The first Giles Carter of whom there is any record in Virginia, came from Gloucestershire,
England, with William Tracey on the Supply, which sailed from Bristol, September 24th, 1620
(O.S.) and arrived at Berkley January 29th, 1620 (O.S.). After looking over the situation
Giles Carter returned to England immediately before or just after the Indian massacre of
Friday, April 1st, 1622. The Carter family of Goucestershire, England, in which Gyles or
Giles appears as a Christian name, was connected with the Tracey family by the marriage
of Gyles Carter and Elizabeth Tracey. This Giles was a son of John Carter of Lower Sewell,
who was High Sheriff of Gloucester in 1612." [sic for the spelling of Tracey]

The last statement is proven beyond all doubt by the Inquisition of 1628 at Tewksbury. However, there
is a second version of these events: Given the other errors, can we trust 1642? Of course not, read the plaque! This entry merely gives us more of the Tracy relatives, and at the same time, demonstrates the false data we have had to live with for many years: Giles Carter: Birth: 1604 in Swell, Gloucestershire, England Death: 1642 in Gloucestershire, England

"Giles Carter came to Virginia with his uncle and aunt, William and Mary Tracy, his first
cousins, Joyce and Thomas Tracy. They sailed on the ship "Supply" out of Bristol,
England destined for Berkely Hundred on 9/25/1620. After the massacre of the settlers
by Indians in 1620, Giles with his cousin Thomas Tracy returned to England. Giles'
cousin, Joyce and her husband Captain William Powell were killed in the massacre.
Giles remained in England, but his son Giles and his wife Hannah returned to Virginia."

In The Matter of The Books Before Us

Can we trust the information on the cousins with the ludicrous last statement? Giles of Henrico wasn't even born yet .... Giles of Cold Aston was sentenced to death in 1666 ... The hand written notes of John Smythe records the death of William Tracy on 8th April 1621. etc.etc.etc. On the other hand, it is well documented that William Tracy was a first cousin of Paul (three times removed) and had petitioned the Crown for the establishment of the Berkely Hundred and had organized the whole of the trip. (See final section below). This confused entry appears to be from Dawson, the same source who said Giles instant removed to King George, and there is some very good information and some very poor information in this same paragraph, isn't there? Need we say more?

A partial answer to the confusion of the dates of the massacre, however, is found on the GenForum of Wesley Tracey of 18 Nov 2003: "...The question of the ancestry of Lt Thomas Tracy of Norwich, CT has been researched by many many people but the question has not been conclusively resolved. Early in the last century, a Dr. Dwight Tracy proposed that he was the son of "Governor" William Tracy of Virginia and had a single sibling, a sister, Joyce. In the book, "Virginia Historical Genealogies", 1975, by John Bennett Boddie, William Tracy is shown as having been appointed, along with one George Thorpe, to govern the colony of the Berkeley Hundred in Virginia. Captain Tracy and his wife were slain by Indians on 6 April 1621. Their daughter Joyce and her husband, Capt Nathaniell Powell, were killed the following year in an Indian massacre on 22 Feb 1622. "Thomas Tracy, son of Capt. William Tracy, survived and returned to England." There is speculation that he grew to maturity in England and later returned to New England to become our ancestor, Lt Thomas Tracy of Norwich".

See the final section below for the Joseph Carter Hypothesis on the possible connection between the two Giles; even though Henrico is conveniently just up-river from Jamestown, it is curious the two Giles Carter from Gloucestershire arrived in Henrico. Joe alleges both sets of Carter instant married with the Stratford, but that will be a separate matter at a later date. On the other hand, contrary to Dawson, Giles of King George is a completely different person and family, probably a refugee from the religous strife across the river in Maryland! Dawson is frankly right behind Dr. Miller in making false assumptions and erroneous connections to the Carters of Colonial Virginia. Once and for all, the two sets of Carter from Gloucestershire are now clearly identified:

Giles m. Tracy was born 1584 to John (married 1605, visited Henrico in 1620, died in Cold Aston in 1664)
Giles m. Rowen and Crews was born 1634 to Theodor (arrived 1653, first marriage 1660, second 1675)

Once more with feeling .............. Throw The Bloody Books Away!

Giles 1634 Cirencester - 1701 Henrico - An Unlikely First Cousin

[For consistency, we use the dates of christening for all the children of Theodore - common sense then says to deduct a month or two for the actual date of birth].

" I have received confirmation from the records office in Gloucestershire, England, of the baptismal record of Giles Carter, who immigrated to Henrico County, Virginia. Here is the actual reply I received:

"A member of staff checked the baptism register for the parish of Cirencester (P86) for the year 1635 and I can confirm that the baptism of Gyles, son of Theodor [?Theodore] Cartor is recorded. The spelling of names was not standardised until fairly recently and so the slight difference in spelling of both the christian and surnames is not significant."

Lavere Peters on her RootsWeb proves we have the correct Giles (Gen. Carter confirms the deposition):

"A more likely theory for the father of Giles is Theodor CARTER who,according to the IGI for parish records of Cirencester, Gloucestershire, England, had a son Giles born in 1634 and christened 24 April 1635. That birth date coincides with Giles's 1680 deposition, in which he declares himself to be 46 years old. Also, our Giles CARTER named his first son Theodrick. [touche .... only, of course, if you realize his father was not Giles]

"I suspect that Theodor CARTER may have been related in some way to the Giles CARTER who made a trip to Virginia in 1621 [** see above] and/or to Gyles CARTER, Esq. of Cold Aston; so we may still latch onto some of the medieval folks. The children attributed in the IGI to Theodor are Mary, Giles, Joane, Elizabeth, and Margery".

We now have proof the visitor was the same Giles of Cold Aston, accompanied by his aunts, uncles and cousins from the Tracy. As an aside, during our search for the visitor, we discovered RootsWeb postings that cite several Carters/Giles jumping over from Maryland during it's "religous strife" of the 17th century. From our earlier work on both branches of the Carters of Lancaster, we know the Brent estate at Aquilla, Stafford County is a singular example of the migration. It was settled by William Brent who was the first Catholic in Virginia, and subsequently owned by Robert King Carter but managed and operated by his cousins and nephews from Capt. Thomas Carter. The refugees from Maryland could well be the source for Giles of King George, which of course sits right on the Potomac River, upstream and right next door to Northumberland which is proven to be the first place of refuge. And, by the way ..... Stafford sits right above King George ..... on the Potomac.

The Two Marriages of Giles of Henrico - Probably

This is the date of the patent, there is no clue as to when the fifteen persons actually came over; although it is not proof in the strict sense, this would be our Giles instant in that he would be at the "perfect age" of eighteen. Merely by common sense, he would then serve his indenture for a few years and first marry by 1660. (There are random and unproven statements that the indenture was in fact for three years).

Henrico Co., Va. Patent Book 3, page 192:
Mr. William Fry, 750 acres near the head of Chichamony River on SW side thereof, 7 April 1653. Beg. at Fleets quarter including a small indian field, for transporting 15 persons: Giles Carter, Ralph Spendlowe, Jane Walker, Miles Noble, Anne Williams, William Brooke, Ralph Burton, Andrew Miller, Alice Archer, the said Fry's wife and his three children, Dorothy Miller, William Hoccadie(?Hockaday).

The Randolph A. Malone book "Josiah Carter: His Forebears, Descendants and Allied Families", (Grandson of Thomas Carter Sr. who is currently styled as Thomas of Goochland) appears to answer the confusion over Hannah. After his presumed indenture with William Fry who was on the northern border of Henrico County, our Giles would have been a Free Person and eligible for marriage circa 1660 at age twenty-five:

"It is likely that as a young man Giles Carter was married to a daughter of John Rowen, since in a 1662 will he left the use of his house and land on a plantation to Giles for a year. Shortly thereafter Giles was well established in the eastern end of Henrico Co. near the Charles City Co. border. By 1676 he was married to Hannah Crewes, daughter of James Crewes". etc.

Bill Husler cites the same will but goes on to provide excellent follow-on connections in his RootsWeb (database-billhusler). First off, Bill is another rare researcher, together with Ms. LaVere Peters, who frequently uses alleged, proposed and possibly at the appropriate time. Yes, there are several other transactions to show they were in the same area, but what evidence is there for Giles instant to be in the employ of Capt. James Crewes, Merchant?

"1 May 1662 The will of John ROWEN of Henrico Co gives Giles CARTER a cow and the use for one year of a house and land on Rowen's Turkey Island estate. 2 John ROWEN was the stepfather? of Daniel and John PRICE; Daniel PRICE later married Susannah, daughter of Giles CARTER. One of the witnesses of this will was Margaret CREWS, daughter of Daniel LLEWELLYN and considered by some to have been the wife of James CREWES; if so, she must have died before 1676.

On the other hand, there is nothing to say he was not first "properly" married to Margaret Llewellyn!

"Before 1676 Apparently Giles CARTER was employed by, or associated with, Captain James CREWES who owned a large plantation in Henrico. Crewes was a merchant and acted as agent for Daniel LLEWELLYN
(Virginia Colonial Records, Vol. II, pages 8, 10, 22, 29, 50, etc.). CREWES became involved in Bacon's Rebellion and was sentenced to death and hanged on January 24, 1677. (Minutes of the Council and General Court of VA, pages 455, 528) pp 34-40".

Tracys Arranged a Passage,. Our Giles Thumbed a Ride

And then, Bill provides one possible answer to our concern about the apparent disparity between the two sets of Carter from Goucestershire, both of whom married with the Stratford according to Joe Carter: one set arranged a whole passage, while Giles instant had his passage paid for. Wouldn't the following also set the stage for the Sentencing of a (cousin) Giles of Cold Aston in 1666? (Remember, Giles m. Tracey died in 1664)

"NOTE 2. I wonder if his arrival in Virginia about 1653 was related to the political scene in England; 1653 was the beginning of the Cromwell years. During the preceding "Great Rebellion of 1642-48, Giles CARTER (his supposed father) was sequestered and compounded for 968 pounds, 17 shillings. p 104"

Yes, but how does this explain the fact that William Frye paid for the passage of our Giles? For example ...... should we consider the following, given it has the correct early details and separates the two Giles Carter of Gloucestershire? {No source cited). Our basic question remains unanswered, but would a horse thief turn out to be a rather successful businessman of his own?

"Our Carter Ancestors came from the County of Gloucestor, England. John Elizabeth Tracy, daughter of Sir Paul Tracy, Knight and Baronet of prior to 1577. On Jan. 26, 1619, William Tracy, Esq., of Hayles, Gloucestorshire petitioned the Virginia Company for a land grant to to be called Barkley's Hundred. Their ship was named "Supply" sailed the ones named were assacred by the Indians March 1622. Giles escaped. Another Giles Carter appeared in Virginia in 1653, listed as headright had been jailed in England for Stealing a horse and went before the Privy Council to be freed and transported to Virginia... "

Billie Harris' notes on William Randolph of Turkey Island set the stage for the second marriage:

In 1676 Turkey Island was partly owned by James Crew (one of the members of Bacon's Rebellion, and who was hanged) but in 1684 his heirs sold 600 acres to William Randolph, progenitor of The Randolphs of Virginia..

These Legacies being paid as also with debts have or shall be lawfully by me contracted, being fully satisfied. Itis my will and desire that what of my Estate shall Remaine (one fether bed and furniture only excepted) for my wife hanna (which I give unto her) may be equally divided into two parts, the one part whereof to belong to my wufe Hannah the other to my son Giles. it not being my intent or design in any wise hereby to disannull or make voide a deed of Gift formerly by me made to my son Giles and entered upon Record. But I doe by this last will and testament Rattifie and confirm the same.

Item. It is my will and desire that what Extate shall appertaine to my son Giles that he may receive the same when he shall arrive at ye age of eighteen years: and also injoy the benifit of his Labour, my wife Hannah not being any wise mollested or disturbed upon the plantacon we now live upon during her life

Possible First Cousins - Did Both Sides Marry Stratford?

Yes, it is intriguing that both Giles Carter instant came from the same general area of Gloucestershire and arrived in Henrico. However, there appears to be a wide disparity between the two as noted above ... and yet ... look at the flow of the names in the second column! A summary of the Joseph Carter Hypothesis (first column proven, second column guesses down to Theodor). These are all in Gloucestershire, just several miles from each other to the immediate west of Stow-on-the-Wold:

The ancient Roman town of Cirencester is some twenty miles southwest. Thing is, Joe has dug up another Three Party Deal to show that Lucy Tracy, another daughter of Sir Paul, was married to Bray Ayleworth in Cirencester! Curious ..... tantalizing ..... but we still need a Carter to Stratford marriage in Cirencester!

[Clearly, there is no Thomas or Theodrick down at this level.]

yadda, yadda, yadda .... dozens of descendants ..... he confused himself! John the Elder of Charlton Abbots was a son of John of Netherswell per his last entry above. There were subsequent nephews named Giles but they were not the ones to marry Tracy!

"Vic you are correct in saying that the Giles Carter married to Elizabeth Tracy was associated with the Tracy's before his marriage to Elizabeth. His Father John Carter's wife Mary Lawrence was the daughter of Robert Lawrence and Eleanora (Elinor) Stratford , Eleanor Stratfords Father Was John Stratford that was married to Margarett Tracy daughter of William Tracy , John Stratford's sister Alice was the Wife of Edmund Broadway , John Stratford's sister Margaret was the wife of Edward Baugh.

This set of marriages to the Tracy begins to explain the travels of John of Badgeworth from Pryton at Churchdown, to Netherswell, to Badgeworth itself. We still need to see any marriage of a Carter of Cirencester to a Tracy! And to a Stratford!

In 1530, Sir William Tracy left a heretical Will, whereby he relied for his salvation on faith rather on the prayers of the Monks.

Richard Tracy acquired Stanway, at the Dissolution and his son Paul was created Baronet in the Reign of James the First, ( 1603 - 1625 ) and eventually passed to a younger son of Toddington. It is presently in the possession of the Earl of Wemys and March, who has a Tracy Pedigree.

William Tracy of Hailes, who was involved greatly with the Stratford's of Bushley, was one of the first to help in the Colonisation of America, through his connection with the Virginian Company and in the year 1620 Sir Paul was in partnership with John Stratford of London, growing tobacco in the Winchcombe area of Gloucestershire.

The Tracy Family history is a book on its own, and I will not attempt to pursue it further, except to state that when the Stratford family became financially estranged at Farmcote, it was Robert Tracy who bought the estate. Today's representative of this great Family is the Baron Sudeley.

Sir Paul Tracy, who succeeded to the manor of Stanway. He was created a baronet June 29, 1811,
[ ....... 1611 of course ..........] by King James I., "being the thirteenth created from the institution of the order." He married first, Anne, daughter and heiress of Ralph Sharkeley, of Ayno-on-the-Hill, County of Northampton. They had twenty-one children.

The ancient manor of Stanway in the Cotswolds was presented to Tewkesbury Abbey in the year 715 by two Mercian leaders Odo and Dodo. It was the first and only remote property owned by the Abbey until the 12th century when land was acquired in Dorset. Stanway supported four monks.

In 1533 Richard Tracy, the younger son of Sir William Tracy of Toddington obtained the lease of the manor from Abbot Segar. Richard is known to have led the commission that dissolved Hailes Abbey and it was around this time that he was able to purchase the freehold to Stanway. It was his son Paul who rebuilt the house incorporating some of the early Tudor house in it. This work started in about 1580. Paul Tracy was created Baronet in 1611 and died in 1620. His son, Sir Richard Tracy, continued building and it was he who had the magnificent gatehouse erected in 1630. He died however in 1637.

Giles Carter, who came to Virginia several years later than the others, and died in Henrico County in 1701 at the age of 67 years, leaving sons Giles and Theodorick, and daughters Mrs. Davis and Mrs. Williamson. So far as known he never held any military or political position, and is supposed to have belonged to the Gloucester Carters. His descendants were chiefly settled in Henrico, Goochland, Prince Edward, and Halifax counties. An interesting account of them has been published by Gen. W. H. G. Carter, U.S.A."

Joseph: Looking back over you history I found this note. Need to share a couple of things. We are similar in that Giles married Hannah and I prefer to think it is Crewes. History supports this pretty well altho there is no proof as yet. This Giles came in 1653 passage paid by William Fry. He was born 1634 and will probabted 1700. Theodrick married Elizabeth Webb Randolph and he had children Ann, Susannah, Theodrick, Martha, Mary, Hannah, John and Elizabeth.

Theodrick's siblings: Susannah, Mary and Ann and Giles born 1682 who married Mary Povall.

The one thing you write of is a myth which persists and I can say this with authority. In the 1970's my father and I went to England. We visited a little English village called Cold Aston. There is a small church there, quite charming and very old. There are two ancient plaques on the wall there that commemorate Giles Carter who married Elizabeth Tracey. The first one you see hangs near the door and states that this was a very devoted and good couple who died "without issue" --NO CHILDREN. This is further substantiated by the other plaque which is back in a dark corner and states that Giles and Elizabeth left their holdings (estate) to two hephews--Edward and Goddard.

We spent the rest of the week in and out of libraries and churches in the area. Nothing refutes those two plaques. Although it is possible to find other Giles' it is for all easy searches impossible to find out who Giles 1634-1700 was the son of or where he left England from. We assumed for our search that he left from Glousteshire and that PERHAPS he was from this family but he definetely is not the son of Giles and Elizabeth Tracy Carter.

I have received confirmation from the records office in Gloucestershire, England, of the baptismal record of Giles Carter, who immigrated to Henrico County, Virginia. Here is the actual reply I received:

"A member of staff checked the baptism register for the parish of Cirencester (P86) for the year 1635 and I can confirm that the baptism of Gyles, son of Theodor [?Theodore] Cartor is recorded. The spelling of names was not standardised until fairly recently and so the slight difference in spelling of both the christian and surnames is not significant."

More importantly, the name of his father is revealed!

Giles married Hannah Crews. Hannah was born in c 1638 in Turkey Island, Henrico Co., Virginia. [Group Sheet]

I invite any and all to review and comment on my conclusions concerning the identity of Hannah (born about 1652), the wife of Giles Carter of Turkey Island, Henrico County, Virginia. Hannah married Giles in about 1670; and their children were: Theodorick (born about 1672), Susannah (born about 1674), Mary (born about 1676), Ann (born about 1678), and Giles Jr. (born after September 14, 1681).

My Conclusions:

Although no official record has been found which explicitly identifies Hannah's parents, circumstances indicate she was a daughter of James Crews and an unidentified Native American woman. This conclusion is supported by the following:

1. James Crews devoted most of his will to the family of Giles and Hannah Carter, naming and providing for each family member separately. Although he did not state his relationship to the Carters, he provided for them in a manner traditionally reserved for children and grandchildren. Later, when the Carters sold land inherited from James Crews, they both signed a deed which states that James Crews gave the land to "Giles and Hannah Carter." (*** Further details above) This additional information, that James Crews gave the land to Hannah as well as to Giles, considered in the context of an era of limited female property rights, highlights Hannah as the likely child of James Crews. James Crews' reluctance to clearly state that Hannah was his daughter, indicates an unusual aspect to their relationship--which is better understood in light of additional information.

2. James Crews may have married Margaret Llewellyn after August 10, 1654, when Margaret witnessed a deed signing her maiden name, and before February 6, 1664, when Margaret's father wrote his will, leaving his daughter, "Margaret Cruse," and "her husband" money to buy memorial rings. If so, Margaret must have died before James wrote his will on July 23, 1676.

3. The attorney for the executor of James Crews' estate testified that James Crews "left no widow or lawful child." The attorney's inclusion of the word "lawful" implies that James Crews left an "unlawful" child--one who was born outside of wedlock. This, in part, explains why James Crews was reluctant to clearly state in his will that Hannah was his daughter. The other part of the explanation comes from general information about white/non-white relations in Colonial Virginia as well as specific information about James Crews' associations.

4. The social consequences in Colonial Virginia for a white man having a child outside of wedlock depended upon the mother's heritage. Fines and corporal punishment for free white men and white women--whether servant or free, who had a child together outside of wedlock were clearly defined and strictly enforced. In contrast, fines and punishment for free white men and non-white women, who had a child together outside of wedlock were practically non-existent. So, since Hannah probably was a daughter of James Crews, who was born outside of wedlock, yet no court records document the conviction and punishment of James Crews and Hannah's mother for such a transgression, Hannah's mother probably was non-white.

5. Since James Crews willed a "negro maid" to Hannah, it is unlikely that Hannah's mother was African American.

6. Since James Crews "kept an Indian," Hannah's mother could have been Native American. With other alternatives eliminated, this mere possibility becomes a virtual certainty.

7. In summary, circumstances indicate that:
(a) Hannah's father probably was James Crews (from his will and the Carter's deed), and
(b) James Crews may have married Margaret Llewellyn (from Daniel Llewellyn's will), and
(c) Hannah probably was born out of wedlock (from the attorney's testimony that James Crews left no "lawful" child), and
(d) Hannah's mother probably was non-white (from strict Virginia statutes and enforcement yet no conviction and punishment), and
(e) Hannah's mother probably was not African American (from James Crews' gift to Hannah of a "negro maid"), and
(f) Hannah's mother could have been Native American (from James Crews' permit to "keep an Indian").

Taken as a whole, these circumstances indicate that Hannah's parents were James Crews and an unidentified Native American woman.
