[page 120] Mitchell from Devin Execr This Indenture made this Sixth day of June in the year of Our Lord Christ one thousand eight Hundred and Six between Robert Devin Surviving Executor of William Devin Dec'd of the one part and John Mitchell of the County of Pittsylvania of the other part. Witnesseth that the said Robt Devin for & inconsideration of The Sum of Fifty Seven pounds 2/9d lawfull money of Virginia to him in hand paid by the said John Mitchell the receipt whereof the said Robt Devin Doth hereby acknowledge hath bargained sold, & by thes present doth absalutely Give Grant bargain sell & confirm unto the said John Mitchell one Certain Tract or Lot, of land lying & being in the County of Pittsylvania on both sides of Banister river Containing Ninety ^five & /4^ acres
be the same more or Less It being part of the land directed to be sold by They Executors to the Will of William Devin dec'd and Jointly purchased, at the Day of sale by the legatus of said Devin Dec'd and after this Lot, was drawn for Sarah Devin, and bounded as followeth To Wit, Beginning, at a [Locash buish] in the old field near the apple orchard, thence a New ^dividing^ line North 15 degrees West, 130 po to a Black Jack Corner in the old line thence the same North 64 Degrees West 5 poles to pointers south
55 Deg.s West 140 poles crossing Banister to pointers South, 31 Degrees East 116 poles to pointers in said old line thence a New Dividing line North 61 Degress, east
106 pos to the Beginning which Tract or lot of land aforesaid the said Robert Devin Executor of William Devin Dec'd Will for himself & his heirs forever Warrant maintain & Defend, the right & Title to the said John Mitchell
his heirs and assigns against they Claim or Claims of any person or persons Whatsoever, Lawfully Claiming and that he the said John Mitchell his heirs [&] is hereby allowed by said Robert Devin to have Quiet & Peacible Possession of the aforesaid Land, In Witness whereof the said Robt Devin has hereunto set his hand and afixed his seal the Day & year above Written Robert Devin Ex. Signed seald & [and] Delivered in the presents of At a Court held for Pittsylvania County the 21st Day of [page 121] July 1806 This Indenture from Robert Devins Surviving Executor of Will Devin Deceased to John Mitchell was presented in Court and acknowledged by the said Robert Devin to be his act and Deed and by the Court Ordered to be Recorded. A pole is slightly over five (5.03) meters or 16.5 feet. Legatus is Latin for 'one who is appointed' to usually serve as an ambassador. Tobacco was considered lawfull money of Virginia in the early nineteenth century.
