Oakes from Devin Deed This Indenture made this 13th day of May in the year of our Lord one Thousand eight hundred and forty eight between Sally Devin of the one part, and James Oakes of the other part; both of the County of Pittsylvania and State of Virginia, witnesseth, that the said Sally Devin for and in consideration of the sum of seventy seven dollars to her in hand paid by the said James Oakes the receipt whereof is hereby acknowledged hath bargained and sold and by these presents doth give, grant, bargain, sell and convey unto the said James Oakes one certain tract or parcel of land lying and being in the County of Pittsylvania on the waters of Ban= ister Creek containing Thirty Eight acres more or less and bonded as followeth, to wit, Beginning at a stake formerly a Stump S 17 E 67 poles to a Birch, thence S 85 W 21 poles crossing Banister to a white oak, then N 75 W 124 poles to pointers, then North 62 poles to a pointer white oak N 73 E with Benjamin Folers line to a walnut then a new line S 30 1/2 E 30 3/4 poles to a forked spanish oak, then N 37 3/4 E 25 poles crossing Banister to the beginning. - To have and to hold the aforesaid tract or parcel of land unto the said James Oakes to him and to his heirs [&] forever, and the said Sally Devin doth for herself warrant and defend the right and title to the aforesaid tract or parcel of land unt the said James Oakes to him and to his heirs [&] forever. In whtness whereof the said Sally Davin has hereunto set her hand and affixed her seal this the day and year first above written. - Recorded 19.June.1848; deed dated 13.May.1848 for 38 acres from Sally Devin to James Oakes. Lying on both sides of the Banister river and adjacent to Fowler.
- Abstact:
Contains 38 acres lying on both sides of Banister Creek. Beginning at a stake formerly a Stump: - S 17 E -- 67 poles to a Birch.
- S 85 W -- 21 poles crossing Banister to a White Oak.
- N 75 W -- 124 poles to pointers.
- N -- 62 poles to a pointer White Oak.
- N 73 E with Benjamin Fo[w]lers line to a walnut.
- S 30.5 E -- 30.75 poles a new line to a forked spanish oak.
- N 37.75 E -- 25 poles crossing Banister to the Beginning.
- This deed sells a portion of land that Sarah Devin inherited from her father, Willaim Devin, Sr. By his will (Deed & Will Book 11 page 243-244), Sarah could dispose of only a half of the inheritance if she did not have any legal children. This tract is apparantly part of that half. It is just north of her parcel and was part of the land William Devin, Sr. acquired from William Leaks (east side of the Banister) and from a land grant recorded by Grant Book 39:463-464 (west side of Banister). This plat has errors. The plat, as written, does not close by a wide margin and has over 70 acres. Even after adjusting for the most obvious error, it still has almost 48 acres.
Transcriber's Comments:
a) The beginning stake could be the "old corner stump in James B. Gatewood's line" per Deed 49:276.
b) Per Deed 49:276, Line #5 should be South 73 degrees East. Oakes is going the opposite direction from Fowler's plot.
