I Robert Divin (sic) of Pittsylvania county do hereby make my last will and Testament in manner and form following that is to say 1st It is my will and desire that all my just debts be paid. 2th I give and bequeath to my beloved wife Nancy Devin all of my land with all of their improvements on the South side of Little Strawberry Creek as followeth to wit Beginning on the creek where my land and John W. Thomas do crop the said Creek thence up the same to the fork in the Old Field (?) opposite to Frizzles Oto House (so called) thence up the right half fork to the mouth of Nicholas Parrish or Cedders (sic) Springs branch (so called) to where my line do crop said Branch joining on where Wilson Parrish line do crop my lines thence my lines in an east direction as they may run to the Beginning and I do further give to my wife aforesaid thirty acres of land agreeable to a new patent lying between the lines of Robert Pierce and John W Thomas. I also give to my said wife the following slaves to wit one negro man named Isaac one woman named Rachel together with her present and future increase, one woman named Aggy together with her present and future increase, one man named Danridge also one negro girl named Mariah with her increase, also one half of my household and kitchen furniture, one half of my stock of horses, cattle, sheep and hogs and one half of all of my property of every kind not herein named, one half of all monies which I may have on hand at my death, and half of all debts due me whether by?? or otherwise all of which I give and bequeath to my said wife Nancy Devin to her and her heirs forever to direct control and dispose of as she may think proper provided nevertheless should my wife intermarry with any person in that case the full two thirds of the gift aforesaid shall forever cease and be null and void and decend(sic) to the present children of my daughter Sarah Smith Hurt equally or those of them who may live to the age of twenty one years of age or may be married to them their heirs forever and one third of the Gifts to remain complete at the disposal of my wife aforesaid as she may think prudent and proper. 3th I give to my daughter Sarah Smith Hurt the following slaves to wit, Delphi, Ana, Ann, America, Henry, Amal Children and Nodah together with their increase to her and her legal heirs forever. 4th I give to my grandson William M Hurt one negro boy named Augustine. I give to granddaughter Nancy Perkins Hurt one negroe girl named Eliza. I give to my granddaughter Louisia James Hurt one negroe girl named Linda. I give to granddaughter Elizabeth Agness Hurt one negroe girl named Mix(?). I give to my granddaughter Mary Ann Hurt one negroe girl named Suckey to them and their heirs forever but should either of my grandchildren die before they marry or arrive to lawful age in that event their parts or part is to decend(sic) to those of them who may live to lawful age or marry. Equally, I further give to my two grandsons Robert S Hurt and William M Hurt four hundred acres of land agreeable to a deed from George Adams to which land is to be divided equally in quantity and if any difference in the quality it is to be made equal and to be so divided that the waters of the south branch of Little Strawberry Creek shall be in the south lot and those of the north fork to be in the north lot to them and their heirs forever. I further give to my daughter Sarah S Hurt and her children equally all the residue or balance of my estate both real and personal whatever to them and their heirs forever. My further will is that my daughter and her children shall live in the house with my wife as usual but should discontent and discord be the case as she my wife will be the owner and minster of what I have given unto her and that no person shall have the control over her in any wise but would advise my daughter to settle her own lands and if such an event should take place I do counsel and advise my wife (her mother) to aid and assist her in so doing. It is my further Will and desire that shall not be any appraisement of my personal estate unless it be absolutely necessary and at the particular request of my wife and daughter Sarah S Hurt and in that event my Executors are hereby authorized to appoint two or three persons to divide equally between my wife and my daughter Sarah S Hurt all of the personal property herein named not particular disposed of. And lastly I do hereby constitiute and appoint my loving wife Nancy Devin and Sarah S Hurt my Executrix with Samuel Beck and Jabez Smith Executors of this my will and testament revoking all former wills and testament by me heretofore made in witness whereof I do hereunto set my hand and affix my seal this 20th day of August in the year 1825

I, Robert Devin, on further reflection, since making the within last will and testament have thought proper to withdraw or strike out Samuel Beck as one of my executors named therein deeming it useless and unnecessary, have more than needful. Given under my hand and seal this 11 day of May 1829

Will of Robert Devin of Pittsylvania County Virginia was written 20.August.1825 and probated on May 19,1834. It is recorded in Pittsylvania County Will Book 1 page 265. He gave land to his wife and his grandsons. At the time, his daughter and grandchildren must have been living with Nancy and him. He divided his property between his wife, daughter, and his grandchildren. Executors were Nancy Devin (wife), Sarah Smith Hurt (daughter), and Jabez Smith. He names the following heirs:
