- Nancy Fitzgerald and husband Thomas Fitzgerald - Petition for Divorce, Caswell County, N.C. NC General Assembly Session Records Nov-Dec 1811 Box 3: Petition of Nancy Fitzgerald of Caswell County, North Carolina represents that she intermarried with a certain Thomas Fitzgerald with whom she lived about six years, and by whom she had three children. Her said husband eventually gave in to intoxication and other kinds of dissipation and extravagance, and "after spending the whole of his property, left your petitioner and children in a lamentable situation dependent wholly upon the benevolence of her father, and fled to the State of Kentucky, where he has, or is about to marry another woman, as appears from a letter accompanying this petition." Prays for a law securing to her such property as she may hereafter acquire by industry or otherwise. Divorce Granted!

James M. Powell is a son of John and Margaret Powell. He is named in his father's will. He lived in Caswell Co. N C. Mrs. Butler reported that Elizabeth Powell married her Uncle. I find no James Powell, son of David Powell who could be Jerald Powell's father. Can he be identified in any census record or will? I don't think so. The James Powell in Caswell belongs to our Powell family not David Powell's. He lived to be a very old man. He was declared unable to attend to his affairs before he died which was in the 1840's. I am not at home and can not see the exact date. James M. Powell had 10 heirs. He had Nancy who married Thomas Fitzgerald and Elizabeth who married James Grant jr. He had a son name Edward and somtimes he is listed as Edmond. He had a son named James M. who married Betsy Mitchell. He may have had a son named John. James M. Powell was born in the 1750s in Stafford Co. Va. He came to Caswell Co. with mother and step-father Elizabeth and Duke Whalebone. Elizabeth Powell Grant was born in 1779. She is one of his oldest children. I sure wish I could id all his children.
