      This Indenture made this 14th day of June in the year of our
      Lord one thousand eight hundred and forty five Between Sarah Divin
      of the County of Pittsylvania and State of Virginia of the one part and
      James Oakes of the County and State aforesaid of the other part:
      Witnesseth that the said Sarah Divin for and in consideration of
      the sum of four hundred and thirty six dollars of lawful money of
      Virginia to to her in hand paid by the said James Oakes at and before the
      ensealing and delivery of These presents the receipt whereof is hereby
      acknowledged have bargained and sold and by these presents doth
      bargain and sell unto the said James Oakes his heirs and assigns a
      certain tract or parcel of land lying and being in the County of Pittsylva=
      nia on the waters of Banister River containing one hundred and nine
      acres be the same more or less and bounded as follows To wit, Begin=
      =ning at a ^new^ corner red oak in Benjamin Fowlers line. Thence new lines
      S 114 poles crossing a branch to new pointers in said Sarah Divin line.
      N 75° W 38 poles to a fallen down corner post oak in Nancy Thomas's
      line. S 55° W 112 poles crossing a little creek to pointers in Jane Pierce's
      line. Thence along said line N 4° E 92 poles crossing two branches to pointers
      N 24° E 100 poles to a red oak. N30° W 70 poles to two red oaks in said
      Fowlers line. Thence S 55° E 145 poles to the beginning which tract or
      parcel of land is a part of the original tract or parcel of land bequeathed
      to the said Sarah Divin by her father William Divin Decd which
      said tract was lately divided by an order of the county court of Pitts=
      =ylvania. (for a more full discription of said tract of land, reference
      may be had to the last will and testament of said William Devin
      Decd which will was duly recorded in the Clerks office of Pittsyl=
      vania County. Together with all and singular the Lands, Tenements
      ways, waters, water courses, priviledges, profits, commodities, advantages
      emoluments, hereditaments, and appurtenances whatsoever to the
      said Land belonging or appurtaining, or with the same used and
      enjoyed, or accepted, reputed Taken or known as part, parcel or
      member thereof, and the revision and revisions, remainder and
      remainders, yearly and other rents, issues and profits thereof, and
      of every part and parcel. To have and to hold the said tract or parcel
      of land with the tenements, hereditaments,, and all and singular [other]
      the premises herein before mentioned, or intended to be bargained and
      sold, and every part and parcel thereof with every of her rights [mem=]
      bers and appurtenances unto the said James Oakes his heirs and assigns
      forever and the said Sarah Devin for herself her heirs the [said]
      tract or parcel of land with all and singular the premises and [ap=]
      purtainances before mentioned unto the said James Oakes his heirs and

      Assigns free from the claim ^or claims^ of the said Sarah Devin her heirs and of all
      and every person or persons whatsoever shall will and do warrent and
      forever defend by these presents. In ^Testemony^ whereof the said Sarah Devin
      have hereunto set her hand and affixed her seal the day and year first above written.

      • Recorded 16.June.1845; deed dated 14.June.1845 for 109 acres from Sarah Diven to James Oakes. Adjacent to Thomas, Pierce, and Fowler on both sides of Little Creek. The tract of land is from the half of the land Sarah Devin received in the will (Pittsylvania County Virginia Deed and Will Book 11 pages 243-244) of her father, William Devin, Sr., that she was entitled to sell if she had no lawful heirs. This deed helps to establish where William Devin, Sr. lived when he died, because it helps to define the land where Sarah was living. Another part of the half was deeded to Benjamin Fowler in Deed Book 49: 276-277.


      • Abstract (Deed 49:275-276)

        Deed dated 14.June.1845 from Sarah Devin to James Oakes for a 109 acre tract of land on the waters of the Banister River in Pittsylvania County Virginia. He paid 436 dollars “Lawful Money of Virginia.” Abstracted by David Devin on 23.December.2005 from a photocopy of the Pittsylvania County Virginia Deed Book 49 pages 275-276.

        Beginning at a new corner red oak in Benjamin Fowlers line:
