      This Indenture made this 17th day of Sept'r in the year of Christ one tho=
      =usand eight hundred and forty nine between James A. Devin commis=
      =sioner of the one part and Thomas S. Jones of the other part whereas
      by a decree of the county court of Pittsylvania in chancery setting
      pronounced on the 20th day of November last in a cause then depend=
      =ing Therein beween James Devin and others vs Biggers heirs, Rey=
      =nolds & others, it was decreed and ordered that the said James A. Devin
      be appointed commissioner and after having given two weeks notice
      of the time and place of sale, do sell on six months credit to the
      highest bidder one half of the tract of land in proceedings men=
      =tioned, and whereas in pursuance of said decree the said James A.
      Devin did on the 2nd day of December 1848 exposed to sale the land
      alluded to in said decree and Thomas S. Jones became the purchaser at
      the sale of ^the^ said tract of land, being the highest bidder therefore -
      and whereas by a subsequent decree of the Court aforesaid pronounced
      on the 21st day of May last in the cause aforesaid, it was decreed
      and ordered that the said James A. Devin be appointed Com=
      =missioner to convey with special warranty the aforesaid tract
      of land to the purchaser - This Indenture therefore witnesseth
      that the said James A. Devin Commissioner [ ] for and in consid
      =eration of the sum of $490.35[/4] to him in hand paid by the said
      Thomas S. Jones before the sealing and delivery of these presents, the
      receipt whereof is hereby acknowledged hath granted, bargained &
      sold and by these presents doth grant, bargain, sell and convey
      unto the said Thomas S. Jones his heirs and assigns a certain tract
      or parcel of land containing one hundred and forty and one tenth
      acres be the same more or less, lying in the county of Pittsylvania
      on both sides of little creek of Banister river. "beginning at Oake's
      and said Jones cor: white oak, then Jones' line formerly Callands
      south 1/2° E 165 poles cross little creek to Callaways cor: pointers [&] then
      his lines N 78° W 97 1/2 pls to cor: red oak N 49° W 81 pls to cor: pointers
      then said Callaways lines, Known as Spurling track N 45 1/2° E 18 poles
      to corner pointers near double chesnut tree, then a crooked line N
      11 1/2° E 28 poles red oak N 9 1/2 E 38 pls crossing said "little creek" to
      crooked a masked tree (stooping) N 12 1/4° E 5 1/2 ples to capt oakes
      fallen down corner post oak, then his line S 73 1/4° 124 poles to the
      beginning - To have and to hold the said tract of land
      with the appurtenances thereto belonging to him the said Thomas
      S. Jones his heirs & assigns forever - and the said James A. Devin
      Comr for himself, his heirs, Executors and administrators hereby
      Convants to and with the said Thomas S. Jones his heirs and
      assigns that he will forever warrant and defend the said
      tract of land hereby conveyed with the appurtenances there=
      =to belonging to the said Thomas S. Jones his heirs and assigns
      against the claim of the said James A. Devin Comr and
      all ^other persons^ claiming the same or any part thereof by fraud
      through or under him, the said James A. Devin commissioner [but]

      • Dated 17.September.1849 deed from James A. Devin, commissioner, to Thomas S. Jones. This deed sells the portion of land Sarah Devin kept after selling tracts to James Oakes and Benjamin Fowler from the land she inherited from her father, Willaim Devin, Sr. This tract of land appears to be the land on which Sarah lived and on which William Devin, Sr. lived before he died.


      • Abstact:
        Tract of land sold 2.December.1848 to Thomas S. Jones for $490.35 as the highest bidder containing one hundred and forty and one tenth acres lying in Pittsylvania County on both sides of Little Creek of Banister River.

        Beginning at Oake's and Thomas S. Jones corner white oak:
        1. S 1/2° E 165 poles along Jones' line formerly Callands crossing Little creek to Callaway's corner pointers
        2. N 78° W 97 1/2 poles along Callaway's lines to a corner red oak
        3. N 49° W 81 poles to corner pointers
        4. N 45 1/2° E 18 poles along Callaways lines (known as Spurlings track) to corner pointers near double chesnut tree
        5. N 11 1/2° E 28 poles along a crooked line to a red oak
        6. N 9 1/2 E 38 poles crossing said "little creek" to a crooked amasked tree (stooping)
        7. N 12 1/4° E 5 1/2 poles to Captain Oakes fallen down corner post oak
